 A BILL TO BE ENTITLED
 AN ACT
 relating to specifying the precinct in a notice to appear before a
 magistrate issued to a person arrested for a traffic violation.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subsection (b), Section 543.006, Transportation
 Code, is amended to read as follows:
 Sec. 543.006. TIME AND PLACE OF APPEARANCE. (a)  The time
 specified by the arresting officer in the notice to appear must be
 at least 10 days after the date of arrest unless the person arrested
 demands an earlier hearing.
 (b)  The place specified by the arresting officer in the
 notice to appear must be before the magistrate in the precinct where
 [a magistrate having jurisdiction of the offense who is in the
 municipality or county in which] the offense is alleged to have been
 committed. The magistrate will dismiss the cause and a complaint
 may not be refiled if the officer fails to comply with this
 subsection.
 SECTION 2.  This Act takes effect September 1, 2011.
