77 relating to the appointment of bailiffs in certain county criminal
88 courts of Tarrant County.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 25.2223, Government Code, is amended by
1111 amending Subsection (j) and adding Subsections (j-1) and (j-2) to
1212 read as follows:
1313 (j) At least two bailiffs shall be assigned regularly to the
1414 County Criminal Court No. 1 of Tarrant County and the County
1515 Criminal Court No. 2 of Tarrant County. Except as provided by
1616 Subsection (j-2), the [The] judges of the County Criminal Courts
1717 Nos. 1 and 2 of Tarrant County shall each appoint one officer to act
1818 as bailiff of the judge's court, and the sheriff of Tarrant County
1919 shall appoint a bailiff for each court as prescribed by law. The
2020 bailiffs serve at the pleasure of the court and shall perform the
2121 duties required by the judge of the court to which the bailiffs are
2222 assigned.
2323 (j-1) At least two bailiffs shall be assigned regularly to
2424 the County Criminal Courts Nos. 3, 4, 5, 6, 7, 8, 9, and 10 of
2525 Tarrant County. Except as provided by Subsection (j-2), each judge
2626 shall appoint one officer to act as the bailiff of the judge's
2727 court, and the sheriff of Tarrant County shall appoint a bailiff for
2828 each court as prescribed by law. A bailiff appointed under this
2929 subsection serves at the pleasure of the court and shall perform the
3030 duties required by the judge of the court to which the bailiff is
3131 assigned.
3232 (j-2) The judge of a county criminal court listed in
3333 Subsection (j) or (j-1) may authorize the sheriff to appoint all
3434 bailiffs in the judge's court. If the sheriff is authorized by a
3535 judge to make the judge's appointment under this subsection, the
3636 sheriff shall appoint at least two officers to act as bailiffs for
3737 the judge's court. A bailiff appointed under this subsection
3838 serves at the pleasure of the court and shall perform the duties
3939 required by the judge of the court to which the bailiff is assigned.
4040 SECTION 2. This Act takes effect September 1, 2011.
