77 relating to patient advocacy activities by nurses and certain other
88 persons; providing an administrative penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (a), Section 301.352, Occupations
1111 Code, is amended to read as follows:
1212 (a) A person may not suspend, terminate, or otherwise
1313 discipline, [or] discriminate against, or retaliate against:
1414 (1) a nurse who refuses to engage in an act or omission
1515 as provided by Subsection (a-1); or
1616 (2) a person who advises a nurse of the nurse's rights
1717 under this section.
1818 SECTION 2. Subchapter I, Chapter 301, Occupations Code, is
1919 amended by adding Section 301.4011 to read as follows:
2020 Sec. 301.4011. GOOD FAITH REPORT BY NURSE. In this
2121 subchapter, a report is considered to be made in good faith if:
2222 (1) the person reporting believed that the report was
2323 required or authorized; and
2424 (2) there was a reasonable factual or legal basis for
2525 that belief.
2626 SECTION 3. Section 301.402, Occupations Code, is amended by
2727 amending Subsection (f) and adding Subsection (g) to read as
2828 follows:
2929 (f) A person may not suspend or terminate the employment of,
3030 or otherwise discipline, [or] discriminate against, or retaliate
3131 against, a person who:
3232 (1) reports in good faith[, without malice,] under
3333 this section; or
3434 (2) advises a nurse of the nurse's rights and
3535 obligations under this section.
3636 (g) A violation of Subsection (f) [this subsection] is
3737 subject to Section 301.413.
3838 SECTION 4. Section 301.4025, Occupations Code, is amended
3939 by amending Subsection (c) and adding Subsection (d) to read as
4040 follows:
4141 (c) A person may not suspend or terminate the employment of,
4242 or otherwise discipline, [or] discriminate against, or retaliate
4343 against, a person who:
4444 (1) reports in good faith[, without malice,] under
4545 this section; or
4646 (2) advises a nurse of the nurse's right to report
4747 under this section.
4848 (d) A violation of Subsection (c) [this subsection] is
4949 subject to Section 301.413.
5050 SECTION 5. Section 301.412, Occupations Code, is amended to
5151 read as follows:
5252 Sec. 301.412. REPORTING IMMUNITY. A person who in good
5353 faith[, without malice,] makes a report required or authorized [,
5454 or reasonably believed to be required or authorized,] under this
5555 subchapter, or a person who advises a nurse of the nurse's right or
5656 obligation to report under this subchapter:
5757 (1) is immune from civil and criminal liability that,
5858 in the absence of the immunity, might result from making the report
5959 or giving the advice; and
6060 (2) may not be subjected to other retaliatory action
6161 as a result of making the report or giving the advice.
6262 SECTION 6. Section 301.413, Occupations Code, is amended by
6363 amending Subsections (a), (b), (c), and (e) and adding Subsection
6464 (b-1) to read as follows:
6565 (a) A person [named as a defendant in a civil action or
6666 subjected to other retaliatory action as a result of filing a report
6767 required, authorized, or reasonably believed to be required or
6868 authorized under this subchapter as a result of refusing to engage
6969 in conduct as authorized by Section 301.352, or as a result of
7070 requesting in good faith a nursing peer review determination under
7171 Section 303.005,] may file a counterclaim in a [the] pending action
7272 or prove a cause of action in a subsequent suit to recover defense
7373 costs, including reasonable attorney's fees and actual and punitive
7474 damages, if:
7575 (1) the person is named as a defendant in a civil
7676 action or subjected to other retaliatory action as a result of:
7777 (A) filing a report required or authorized, or
7878 reasonably believed to be required or authorized, under this
7979 subchapter as a result of refusing to engage in conduct as
8080 authorized by Section 301.352;
8181 (B) requesting in good faith a nursing peer
8282 review committee determination under Section 303.005; or
8383 (C) providing advice to a person regarding:
8484 (i) filing a report required or authorized,
8585 or reasonably believed to be required or authorized, under this
8686 subchapter as a result of refusing to engage in conduct as
8787 authorized by Section 301.352; or
8888 (ii) requesting in good faith a nursing
8989 peer review committee determination under Section 303.005; and
9090 (2) the suit or retaliatory action is determined to be
9191 frivolous, unreasonable, or taken in bad faith.
9292 (b) A person may not suspend, terminate, or otherwise
9393 discipline, [or] discriminate against, or retaliate against a
9494 person who:
9595 (1) reports in good faith[, without malice,] under
9696 this subchapter;
9797 (2) requests, in good faith, a nursing peer review
9898 committee determination under Section 303.005; [or]
9999 (3) refuses to engage in conduct as authorized by
100100 Section 301.352; or
101101 (4) advises a nurse of the nurse's right to:
102102 (A) report under this subchapter;
103103 (B) request a nursing peer review committee
104104 determination under Section 303.005; or
105105 (C) refuse to engage in conduct as authorized by
106106 Section 301.352.
107107 (b-1) A person suspected of violating Subsection (b) may be
108108 reported to the appropriate licensing agency and, notwithstanding
109109 any other provision, that agency may impose an administrative
110110 penalty not to exceed $25,000 against the person if the agency finds
111111 a violation of Subsection (b). An administrative penalty imposed
112112 under this subsection is in addition to other penalties the agency
113113 is authorized to impose and is subject to the procedural
114114 requirements applicable to the appropriate licensing agency.
115115 (c) A person who reports under this subchapter, refuses to
116116 engage in conduct as authorized by Section 301.352, or requests a
117117 nursing peer review committee determination under Section 303.005,
118118 or a person who advises a nurse of the nurse's right to report under
119119 this subchapter, refuse to engage in conduct as authorized by
120120 Section 301.352, or request a nursing peer review committee
121121 determination under Section 303.005, has a cause of action against
122122 a person who violates Subsection (b), and may recover:
123123 (1) the greater of:
124124 (A) actual damages, including damages for mental
125125 anguish even if no other injury is shown; or
126126 (B) $5,000;
127127 (2) exemplary damages;
128128 (3) court costs; and
129129 (4) reasonable attorney's fees.
130130 (e) A person who brings an action under this section has the
131131 burden of proof. It is a rebuttable presumption that the person was
132132 suspended, terminated, or otherwise disciplined, [or]
133133 discriminated against, or retaliated against for reporting under
134134 this subchapter, for refusing to engage in conduct as authorized by
135135 Section 301.352, [or] for requesting a peer review committee
136136 determination under Section 303.005, or for providing advice to a
137137 person regarding reporting under this subchapter, refusing to
138138 engage in conduct as authorized by Section 301.352, or requesting a
139139 peer review committee determination under Section 303.005 if:
140140 (1) the person was suspended, terminated, or otherwise
141141 disciplined, [or] discriminated against, or retaliated against
142142 within 60 days after the date the report, refusal, or request was
143143 made or the advice was given; and
144144 (2) the board or a court determines that:
145145 (A) the report that is the subject of the cause of
146146 action was:
147147 (i) authorized or required under Section
148148 301.402, 301.4025, 301.403, 301.405, 301.406, 301.407, 301.408,
149149 301.409, or 301.410; and
150150 (ii) made in good faith [without malice];
151151 (B) the request for a peer review committee
152152 determination that is the subject of the cause of action was:
153153 (i) authorized under Section 303.005; and
154154 (ii) made in good faith; [or]
155155 (C) the refusal to engage in conduct was
156156 authorized by Section 301.352; or
157157 (D) the advice that is the subject of the cause of
158158 action was given in good faith.
159159 SECTION 7. Subdivision (5), Section 303.001, Occupations
160160 Code, is amended to read as follows:
161161 (5) "Peer review" means the evaluation of nursing
162162 services, the qualifications of a nurse, the quality of patient
163163 care rendered by a nurse, the merits of a complaint concerning a
164164 nurse or nursing care, and a determination or recommendation
165165 regarding a complaint. The term includes:
166166 (A) the evaluation of the accuracy of a nursing
167167 assessment and observation and the appropriateness and quality of
168168 the care rendered by a nurse;
169169 (B) a report made to a nursing peer review
170170 committee concerning an activity under the committee's review
171171 authority;
172172 (C) a report made by a nursing peer review
173173 committee to another committee or to the board as permitted or
174174 required by law; [and]
175175 (D) implementation of a duty of a nursing peer
176176 review committee by a member, an agent, or an employee of the
177177 committee; and
178178 (E) the provision of information, advice, and
179179 assistance to nurses and other persons relating to:
180180 (i) the rights and obligations of and
181181 protections for nurses who raise care concerns or report under
182182 Chapter 301 or other state or federal law;
183183 (ii) the rights and obligations of and
184184 protections for nurses who request nursing peer review under this
185185 chapter;
186186 (iii) nursing practice and patient care
187187 concerns; and
188188 (iv) the resolution of workplace and
189189 practice questions relating to nursing and patient care.
190190 SECTION 8. Subsection (a-1), Section 303.005, Occupations
191191 Code, is amended to read as follows:
192192 (a-1) For purposes of this section, a nurse or nurse
193193 administrator acts [does not act] in good faith in connection with a
194194 request made or an action taken by the nurse or nurse administrator
195195 if there is [not] a reasonable factual or legal basis for the
196196 request or action.
197197 SECTION 9. (a) Subsection (b-1), Section 301.413,
198198 Occupations Code, as added by this Act, and Sections 301.352,
199199 301.402, and 301.4025 and Subsection (b), Section 301.413,
200200 Occupations Code, as amended by this Act, apply only to a violation
201201 that occurs on or after the effective date of this Act. A violation
202202 that occurs before the effective date of this Act is covered by the
203203 law in effect on the date the violation occurred, and the former law
204204 is continued in effect for that purpose.
205205 (b) Section 301.412, Occupations Code, as amended by this
206206 Act, applies only to a report made on or after the effective date of
207207 this Act. A report made before the effective date of this Act is
208208 covered by the law in effect on the date the report was made, and the
209209 former law is continued in effect for that purpose.
210210 (c) Subsections (a), (c), and (e), Section 301.413,
211211 Occupations Code, as amended by this Act, apply only to an action
212212 commenced on or after the effective date of this Act. An action
213213 commenced before the effective date of this Act is covered by the
214214 law in effect on the date the action was commenced, and the former
215215 law is continued in effect for that purpose.
216216 SECTION 10. This Act takes effect September 1, 2011.
