1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to procedures related to the placement of a voter on the
1313 suspense list.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 14.022, Election Code, is amended to
1616 read as follows:
1717 Sec. 14.022. ERRONEOUS RETURN OF RENEWAL CERTIFICATE.
1818 (a) A voter registrar shall determine whether [If the registrar
1919 determines that] a voter's renewal certificate was returned
2020 undelivered solely because of postal service error, address
2121 reclassification, or the registrar's clerical error. If the
2222 registrar determines that the certificate was returned solely
2323 because of that error or reclassification, the registrar shall
2424 delete the voter's name from the suspense list, make any other
2525 appropriate corrections in the registration records, and deliver
2626 the certificate to the voter.
2727 (b) The secretary of state shall adopt rules for the
2828 determination under this section of whether a voter's renewal
2929 certificate was returned undelivered solely because of postal
3030 service error, address reclassification, or the registrar's
3131 clerical error.
3232 SECTION 2. Section 63.0011, Election Code, is amended by
3333 adding Subsection (f) to read as follows:
3434 (f) The secretary of state shall adopt rules to provide for
3535 the uniform and auditable processing of a statement of residence
3636 required under this section.
3737 SECTION 3. The change in law made by this Act to Section
3838 14.022, Election Code, applies only to a voter registration renewal
3939 certificate returned undelivered and received by a voter registrar
4040 on or after the effective date of this Act. A voter registration
4141 renewal certificate returned undelivered and received by a voter
4242 registrar before the effective date of this Act is governed by the
4343 law in effect when the registrar received the undelivered
4444 certificate, and the former law is continued in effect for that
4545 purpose.
4646 SECTION 4. This Act takes effect September 1, 2011.
