| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 14.022, Election Code, is amended to |
|---|
| 16 | 16 | | read as follows: |
|---|
| 17 | 17 | | Sec. 14.022. ERRONEOUS RETURN OF RENEWAL CERTIFICATE. |
|---|
| 18 | 18 | | (a) A voter registrar shall determine whether [If the registrar |
|---|
| 19 | 19 | | determines that] a voter's renewal certificate was returned |
|---|
| 20 | 20 | | undelivered solely because of postal service error, address |
|---|
| 21 | 21 | | reclassification, or the registrar's clerical error. If the |
|---|
| 22 | 22 | | registrar determines that the certificate was returned solely |
|---|
| 23 | 23 | | because of that error or reclassification, the registrar shall |
|---|
| 24 | 24 | | delete the voter's name from the suspense list, make any other |
|---|
| 25 | 25 | | appropriate corrections in the registration records, and deliver |
|---|
| 26 | 26 | | the certificate to the voter. |
|---|
| 27 | 27 | | (b) The secretary of state shall adopt rules for the |
|---|
| 28 | 28 | | determination under this section of whether a voter's renewal |
|---|
| 29 | 29 | | certificate was returned undelivered solely because of postal |
|---|
| 30 | 30 | | service error, address reclassification, or the registrar's |
|---|
| 31 | 31 | | clerical error. |
|---|
| 32 | 32 | | SECTION 2. Section 63.0011, Election Code, is amended by |
|---|
| 33 | 33 | | adding Subsection (f) to read as follows: |
|---|
| 34 | 34 | | (f) The secretary of state shall adopt rules to provide for |
|---|
| 35 | 35 | | the uniform and auditable processing of a statement of residence |
|---|
| 36 | 36 | | required under this section. |
|---|
| 37 | 37 | | SECTION 3. The change in law made by this Act to Section |
|---|
| 38 | 38 | | 14.022, Election Code, applies only to a voter registration renewal |
|---|
| 39 | 39 | | certificate returned undelivered and received by a voter registrar |
|---|
| 40 | 40 | | on or after the effective date of this Act. A voter registration |
|---|
| 41 | 41 | | renewal certificate returned undelivered and received by a voter |
|---|
| 42 | 42 | | registrar before the effective date of this Act is governed by the |
|---|
| 43 | 43 | | law in effect when the registrar received the undelivered |
|---|
| 44 | 44 | | certificate, and the former law is continued in effect for that |
|---|
| 45 | 45 | | purpose. |

| 46 | 46 | | SECTION 4. This Act takes effect September 1, 2011. |
