66 AN ACT
77 relating to training for employees and operators of certain
88 child-care facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 42.0421, Human Resources Code, is
1111 amended by adding Subsections (f) and (g) to read as follows:
1212 (f) The training required by this section must be
1313 appropriately targeted and relevant to the age of the children who
1414 will receive care from the individual receiving training and must
1515 be provided by a person who:
1616 (1) is a training provider registered with the Texas
1717 Early Care and Education Career Development System's Texas Trainer
1818 Registry that is maintained by the Texas Head Start State
1919 Collaboration Office;
2020 (2) is an instructor at a public or private secondary
2121 school or at a public or private institution of higher education, as
2222 defined by Section 61.801, Education Code, who teaches early
2323 childhood development or another relevant course, as determined by
2424 rules adopted by the commissioner of education and the commissioner
2525 of higher education;
2626 (3) is an employee of a state agency with relevant
2727 expertise;
2828 (4) is a physician, psychologist, licensed
2929 professional counselor, social worker, or registered nurse;
3030 (5) holds a generally recognized credential or
3131 possesses documented knowledge relevant to the training the person
3232 will provide;
3333 (6) is a registered family home care provider or
3434 director of a day-care center or group day-care home in good
3535 standing with the department, if applicable, and who:
3636 (A) has demonstrated core knowledge in child
3737 development and caregiving; and
3838 (B) is only providing training at the home or
3939 center in which the provider or director and the person receiving
4040 training are employed; or
4141 (7) has at least two years of experience working in
4242 child development, a child development program, early childhood
4343 education, a childhood education program, or a Head Start or Early
4444 Head Start program and:
4545 (A) has been awarded a Child Development
4646 Associate (CDA) credential; or
4747 (B) holds at least an associate's degree in child
4848 development, early childhood education, or a related field.
4949 (g) A person described by Subsection (f)(6) may provide
5050 training under this section only if the department has not taken an
5151 action under Section 42.071, 42.072, or 42.078, other than an
5252 evaluation, against the license, listing, or registration of the
5353 person or the home or center for which the person is a provider or
5454 director during the two-year period preceding the date on which the
5555 person provides the training.
5656 SECTION 2. This Act takes effect January 1, 2012.
