66 AN ACT
77 relating to the eligibility of certain postdoctoral fellows and
88 graduate students to participate in health benefit programs at
99 public institutions of higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 1551, Insurance Code, is
1212 amended by adding Section 1551.1022 to read as follows:
1313 Sec. 1551.1022. PARTICIPATION ELIGIBILITY: CERTAIN
1414 POSTDOCTORAL FELLOWS AND GRADUATE STUDENTS. (a) An individual who
1515 is not eligible to participate in the group benefits program under
1616 Section 1551.101 is eligible to participate in the group benefits
1717 program under this section if the individual, at an institution of
1818 higher education:
1919 (1) holds:
2020 (A) a postdoctoral fellowship; or
2121 (B) one or more graduate student fellowships
2222 awarded to the individual on a competitive basis that, either
2323 singly or in combination, are valued at not less than $10,000 per
2424 year; and
2525 (2) is currently receiving a stipend from an
2626 applicable fellowship.
2727 (b) An individual who is eligible to participate in the
2828 group benefits program under this section shall pay all
2929 contributions required under this chapter for the coverage selected
3030 by the individual, except that an institution of higher education
3131 may make contributions for the individual from available funds
3232 other than money appropriated to the institution from the general
3333 revenue fund.
3434 (c) An institution of higher education shall determine
3535 which individuals are eligible to participate in the group benefits
3636 program under this section and, at the time of initial eligibility,
3737 shall notify each individual of the individual's eligibility to
3838 participate in the program.
3939 (d) An individual who participates in the group benefits
4040 program under this section is not considered an employee of an
4141 institution of higher education solely as a result of the
4242 individual's participation in the program.
4343 SECTION 2. Section 1551.151, Insurance Code, is amended to
4444 read as follows:
4545 Sec. 1551.151. ENTITLEMENT TO COVERAGE. An individual who
4646 is eligible to participate in the group benefits program under
4747 Section 1551.101, [or] 1551.102, or 1551.1022 is entitled to secure
4848 for a dependent of the individual any group coverages provided
4949 under this chapter, as determined by the board of trustees and
5050 subject to the exceptions provided by this subchapter.
5151 SECTION 3. Subchapter C, Chapter 1601, Insurance Code, is
5252 amended by adding Section 1601.1021 to read as follows:
5353 Sec. 1601.1021. PARTICIPATION ELIGIBILITY: CERTAIN
5454 POSTDOCTORAL FELLOWS AND GRADUATE STUDENTS. (a) An individual who
5555 is not eligible to participate in the uniform program under Section
5656 1601.101 is eligible to participate in the uniform program under
5757 this section if the individual, at an institution in a system:
5858 (1) holds:
5959 (A) a postdoctoral fellowship; or
6060 (B) one or more graduate student fellowships
6161 awarded to the individual on a competitive basis that, either
6262 singly or in combination, are valued at not less than $10,000 per
6363 year; and
6464 (2) is currently receiving a stipend from an
6565 applicable fellowship.
6666 (b) An individual who is eligible to participate in the
6767 uniform program under this section shall pay all contributions
6868 required under this chapter for the coverage selected by the
6969 individual, except that an institution of higher education may make
7070 contributions for the individual from available funds other than
7171 money appropriated to the institution from the general revenue
7272 fund.
7373 (c) An institution of higher education shall determine
7474 which individuals are eligible to participate in the uniform
7575 program under this section and, at the time of initial eligibility,
7676 shall notify each individual of the individual's eligibility to
7777 participate in the program.
7878 (d) An individual who participates in the uniform program
7979 under this section is not considered an employee of an institution
8080 of higher education solely as a result of the individual's
8181 participation in the program.
8282 SECTION 4. Section 1601.107, Insurance Code, is amended to
8383 read as follows:
8484 Sec. 1601.107. COVERAGE FOR DEPENDENTS. An individual who
8585 is eligible to participate in the uniform program under Section
8686 1601.101, [or] 1601.102, or 1601.1021 is entitled to secure for a
8787 dependent of the individual any group coverages provided under this
8888 chapter for dependents under rules adopted by the applicable
8989 system.
9090 SECTION 5. Effective January 1, 2012, Subsection (d),
9191 Section 1601.101, Insurance Code, is repealed.
9292 SECTION 6. (a) The board of trustees of the Employees
9393 Retirement System of Texas shall include coverage under Section
9494 1551.1022, Insurance Code, as added by this Act, in an insurance
9595 policy or contract or evidence of coverage delivered, issued for
9696 delivery, or renewed on or after January 1, 2012. The board of
9797 trustees may include coverage under Section 1551.1022, Insurance
9898 Code, as added by this Act, in an insurance policy or contract or an
9999 evidence of coverage delivered, issued for delivery, or renewed
100100 before January 1, 2012, if the board of trustees determines that the
101101 coverage may reasonably be included.
102102 (b) The governing board of The University of Texas System or
103103 The Texas A&M University System, as applicable, shall include
104104 coverage under Section 1601.1021, Insurance Code, as added by this
105105 Act, in an insurance policy or contract or evidence of coverage
106106 delivered, issued for delivery, or renewed on or after January 1,
107107 2012. The governing board of a system may include coverage under
108108 Section 1601.1021, Insurance Code, as added by this Act, in an
109109 insurance policy or contract or an evidence of coverage delivered,
110110 issued for delivery, or renewed before January 1, 2012, if the
111111 governing board determines that the coverage may reasonably be
112112 included.
113113 SECTION 7. Except as otherwise provided by this Act, this
114114 Act takes effect September 1, 2011.
