99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 101.45, Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 Sec. 101.45. CONTAINERS OF WINE: MAXIMUM CAPACITY. A [No]
1313 person may not sell wine to a retail dealer in a container
1414 [containers] with a capacity greater than eight [4.9] gallons.
1515 SECTION 2. (a) The change in law made by this Act applies
1616 only to an offense committed on or after the effective date of this
1717 Act. For purposes of this section, an offense is committed before
1818 the effective date of this Act if any element of the offense occurs
1919 before that date.
2020 (b) An offense committed before the effective date of this
2121 Act is covered by the law in effect when the offense was committed,
2222 and the former law is continued in effect for that purpose.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2011.
