9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 101.45, Alcoholic Beverage Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Sec. 101.45. CONTAINERS OF WINE: MAXIMUM CAPACITY. A [No] | |
13 | 13 | person may not sell wine to a retail dealer in a container | |
14 | 14 | [containers] with a capacity greater than eight [4.9] gallons. | |
15 | 15 | SECTION 2. (a) The change in law made by this Act applies | |
16 | 16 | only to an offense committed on or after the effective date of this | |
17 | 17 | Act. For purposes of this section, an offense is committed before | |
18 | 18 | the effective date of this Act if any element of the offense occurs | |
19 | 19 | before that date. | |
20 | 20 | (b) An offense committed before the effective date of this | |
21 | 21 | Act is covered by the law in effect when the offense was committed, | |
22 | 22 | and the former law is continued in effect for that purpose. | |
23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2011. |
