| 8 | 8 | | grower may request an extension of the cotton stalk destruction |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Subsections (b) and (c), Section 74.0032, |
|---|
| 12 | 12 | | Agriculture Code, are amended to read as follows: |
|---|
| 13 | 13 | | (b) If adverse weather conditions or other good cause |
|---|
| 14 | 14 | | exists, the administrative committee that governs the applicable |
|---|
| 15 | 15 | | pest management zone may request that the department grant an |
|---|
| 16 | 16 | | extension of the cotton stalk destruction deadline for any |
|---|
| 17 | 17 | | specified part of the pest management zone or for the entire pest |
|---|
| 18 | 18 | | management zone. A request under this subsection must be made |
|---|
| 19 | 19 | | within the period specified by department rule [not later than 10 |
|---|
| 20 | 20 | | business days before the applicable cotton stalk destruction |
|---|
| 21 | 21 | | deadline]. A field is not subject to a hostable cotton fee if the |
|---|
| 22 | 22 | | department grants an extension of the deadline. The Texas Boll |
|---|
| 23 | 23 | | Weevil Eradication Foundation shall submit to the department an |
|---|
| 24 | 24 | | estimate of the amount by which an extension under this subsection |
|---|
| 25 | 25 | | will increase the cost of administering the boll weevil eradication |
|---|
| 26 | 26 | | program. |
|---|
| 27 | 27 | | (c) If the applicable administrative committee does not |
|---|
| 28 | 28 | | request an extension, or if the department denies a request for an |
|---|
| 29 | 29 | | extension of the cotton stalk destruction deadline for a specified |
|---|
| 30 | 30 | | part of a pest management zone, a cotton grower may apply for an |
|---|
| 31 | 31 | | individual extension of the deadline. A request under this |
|---|
| 32 | 32 | | subsection must be made within the period specified by department |
|---|
| 33 | 33 | | rule [not later than 10 business days before the applicable pest |
|---|
| 34 | 34 | | management zone's stalk destruction deadline]. |
|---|
| 35 | 35 | | SECTION 2. The changes in law made by Section 74.0032, |
|---|
| 36 | 36 | | Agriculture Code, as amended by this Act, apply only to a request |
|---|
| 37 | 37 | | for an extension made on or after the effective date of this Act. A |
|---|
| 38 | 38 | | request for an extension made before the effective date of this Act |
|---|
| 39 | 39 | | is subject to the law in effect on that date, and that law is |
|---|
| 40 | 40 | | continued in effect for that purpose. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2011. |
