| 10 | 10 | SECTION 1. Subchapter E, Chapter 76, Parks and Wildlife | |
| 11 | 11 | Code, is amended by adding Section 76.303 to read as follows: | |
| 12 | 12 | Sec. 76.303. SALE OF RAW OYSTERS FOR CONSUMPTION WITHIN | |
| 13 | 13 | THIS STATE. Any federal regulations that prohibit the interstate | |
| 14 | 14 | transport and sale of oysters that have not been postharvest | |
| 15 | 15 | treated do not apply to oysters harvested from waters of this state | |
| 16 | 16 | and sold and consumed in this state. | |
| 17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
| 18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
| 19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
| 20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
| 21 | 21 | Act takes effect September 1, 2011. |
