77 relating to prohibiting state funding to public junior colleges for
88 physical education courses offered for joint high school and junior
99 college credit.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (c), Section 130.008, Education Code,
1212 is amended to read as follows:
1313 (c) The contact hours attributable to the enrollment of a
1414 high school student in a course offered for joint high school and
1515 junior college credit under this section, excluding a course for
1616 which the student attending high school may receive course credit
1717 toward the physical education curriculum requirement under Section
1818 28.002(a)(2)(C), shall be included in the contact hours used to
1919 determine the junior college's proportionate share of the state
2020 money appropriated and distributed to public junior colleges under
2121 Sections 130.003 and 130.0031, even if the junior college waives
2222 all or part of the tuition or fees for the student under Subsection
2323 (b).
2424 SECTION 2. This Act applies beginning with funding for the
2525 2011 fall semester.
2626 SECTION 3. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2011.
