| 7 | 7 | | relating to the de-annexation of land in Bastrop County by the |

| 8 | 8 | | Barton Springs-Edwards Aquifer Conservation District. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Not later than the 30th day after the effective |
|---|
| 11 | 11 | | date of this Act, the board of the Barton Springs-Edwards Aquifer |
|---|
| 12 | 12 | | Conservation District shall declare by resolution that the |
|---|
| 13 | 13 | | territory described by Section 2 of this Act is excluded from the |
|---|
| 14 | 14 | | territory of the Barton Springs-Edwards Aquifer Conservation |
|---|
| 15 | 15 | | District. The board shall file a copy of the resolution in the |
|---|
| 16 | 16 | | office of the county clerk of the county in which the excluded |
|---|
| 17 | 17 | | territory is located. The county clerk shall record the resolution |
|---|
| 18 | 18 | | in the county records. On the date the resolution is recorded, the |
|---|
| 19 | 19 | | excluded territory is no longer part of that district. |
|---|
| 20 | 20 | | SECTION 2. The territory to be de-annexed by the Barton |
|---|
| 21 | 21 | | Springs-Edwards Aquifer Conservation District under this Act is the |
|---|
| 22 | 22 | | territory contained in the following area: |
|---|
| 23 | 23 | | BEGINNING AT A POINT at the intersection of Travis County, Bastrop |
|---|
| 24 | 24 | | County, and Caldwell County; |
|---|
| 25 | 25 | | THENCE, 1840 feet, more or less, N 48° E, along the Bastrop/Travis |
|---|
| 26 | 26 | | County Line to an angle point; |
|---|
| 27 | 27 | | THENCE, 9720 feet, more or less, S 47° E, passing State Highway 21 to |
|---|
| 28 | 28 | | an angle point; |
|---|
| 29 | 29 | | THENCE, 1670 feet, more or less, S 70° W, to an angle point in the |
|---|
| 30 | 30 | | Bastrop/Caldwell County Line; |
|---|
| 31 | 31 | | THENCE, 8840 feet, more or less, N 43° W, along the Bastrop/Caldwell |
|---|
| 32 | 32 | | County Line and passing State Highway 21 to the Point of Beginning. |

| 33 | 33 | | All of the area enclosed by this description is in Bastrop County |
|---|
| 34 | 34 | | and totals approximately 410 acres. |

| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |

| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2011. |
