10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Article 45.037, Code of Criminal Procedure, is | |
12 | 12 | amended to read as follows: | |
13 | 13 | Art. 45.037. MOTION FOR NEW TRIAL. A motion for a new trial | |
14 | 14 | must be made within five days [one day] after the rendition of | |
15 | 15 | judgment and sentence, and not afterward. | |
16 | 16 | SECTION 2. The change in law made by this Act applies only | |
17 | 17 | to a judgment in a criminal proceeding entered on or after the | |
18 | 18 | effective date of this Act. A judgment in a criminal proceeding | |
19 | 19 | entered before the effective date of this Act is governed by the law | |
20 | 20 | in effect on the date the judgment was entered, and the former law | |
21 | 21 | is continued in effect for that purpose. | |
22 | 22 | SECTION 3. This Act takes effect September 1, 2011. |
