| 8 | 8 | | assault training programs and sexual assault nurse examiners and |
|---|
| 9 | 9 | | for certification renewal by those entities. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subdivision (6), Section 420.003, Government |
|---|
| 12 | 12 | | Code, is amended to read as follows: |
|---|
| 13 | 13 | | (6) "Sexual assault nurse examiner" means a registered |
|---|
| 14 | 14 | | nurse who has completed a service-approved examiner training course |
|---|
| 15 | 15 | | and who is certified according to minimum standards prescribed by |
|---|
| 16 | 16 | | attorney general rule. |

| 17 | 17 | | SECTION 2. Subsections (b) and (c), Section 420.011, |
|---|
| 18 | 18 | | Government Code, are amended to read as follows: |
|---|
| 19 | 19 | | (b) The attorney general shall adopt rules establishing |
|---|
| 20 | 20 | | minimum standards for the certification of a sexual assault |
|---|
| 21 | 21 | | training program and the renewal of that certification by the |
|---|
| 22 | 22 | | program. The certification is valid for two years from the date of |
|---|
| 23 | 23 | | issuance. The attorney general shall also adopt rules establishing |
|---|
| 24 | 24 | | minimum standards for the suspension, decertification, or |
|---|
| 25 | 25 | | probation of a training program that violates this chapter. |
|---|
| 26 | 26 | | (c) The attorney general shall adopt rules establishing |
|---|
| 27 | 27 | | minimum standards for the certification of a sexual assault nurse |
|---|
| 28 | 28 | | examiner and the renewal of that certification by the nurse |
|---|
| 29 | 29 | | examiner, including standards for examiner training courses and for |
|---|
| 30 | 30 | | the interstate reciprocity of sexual assault nurse examiners. The |
|---|
| 31 | 31 | | certification is valid for two years from the date of issuance. The |
|---|
| 32 | 32 | | attorney general shall also adopt rules establishing minimum |
|---|
| 33 | 33 | | standards for the suspension, decertification, or probation of a |
|---|
| 34 | 34 | | sexual assault nurse examiner who violates this chapter. |
|---|
| 35 | 35 | | SECTION 3. Not later than December 1, 2011, the attorney |
|---|
| 36 | 36 | | general shall adopt the rules required by Subsections (b) and (c), |
|---|
| 37 | 37 | | Section 420.011, Government Code, as amended by this Act. |

| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2011. |
