| 11 | 11 | | number of finalists for the position of superintendent of a public |
|---|

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 552.126, Government Code, is amended to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | Sec. 552.126. EXCEPTION: NAME OF APPLICANT FOR |
|---|
| 17 | 17 | | SUPERINTENDENT OF PUBLIC SCHOOL DISTRICT. (a) Except as provided |
|---|
| 18 | 18 | | by Subsection (b), the [The] name of an applicant for the position |
|---|
| 19 | 19 | | of superintendent of a public school district is excepted from the |
|---|
| 20 | 20 | | requirements of Section 552.021. |
|---|
| 21 | 21 | | (b) At[, except that the board of trustees must give public |
|---|
| 22 | 22 | | notice of the name or names of the finalists being considered for |
|---|
| 23 | 23 | | the position at] least 21 days before the date of the meeting at |
|---|
| 24 | 24 | | which a final action or vote is to be taken on the employment of an |
|---|
| 25 | 25 | | applicant for the position of superintendent of a public school |
|---|
| 26 | 26 | | district, the board of trustees must give public notice of: |
|---|
| 27 | 27 | | (1) the names of at least three finalists being |
|---|
| 28 | 28 | | considered for the position, if the board of trustees interviewed |
|---|
| 29 | 29 | | three people or more during the final round of interviews for the |
|---|
| 30 | 30 | | position; or |
|---|
| 31 | 31 | | (2) the name or names of all the finalists being |
|---|
| 32 | 32 | | considered for the position, if the board of trustees interviewed |
|---|
| 33 | 33 | | not more than two people during the final round of interviews for |
|---|
| 34 | 34 | | the position. |
|---|
| 35 | 35 | | (c) Before the public notice required by Subsection (b) is |
|---|
| 36 | 36 | | posted, the board of trustees must give an applicant whose name will |
|---|
| 37 | 37 | | be included in the public notice an opportunity to withdraw from |
|---|
| 38 | 38 | | consideration for the position [the person]. |
|---|
| 39 | 39 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 40 | 40 | | with respect to notice of a meeting held on or after October 1, |
|---|
| 41 | 41 | | 2011. A notice of a meeting held before that date is governed by the |
|---|
| 42 | 42 | | law in effect on the date the notice is given, and that law is |
|---|
| 43 | 43 | | continued in effect for that purpose. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2011. |
