77 relating to community assistance and economic development program
88 activities of the Lavaca-Navidad River Authority.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 186, Acts of the 50th Legislature,
1111 Regular Session, 1947, is amended by adding Section 11 to read as
1212 follows:
1313 Sec. 11. (a) In this section, "economic development
1414 program" includes a program designed to:
1515 (1) encourage economic diversification;
1616 (2) contribute to the health and development of a
1717 community to improve the attractiveness of the community to public
1818 and private enterprises; or
1919 (3) improve the quality or quantity of services
2020 essential for the development of viable communities and economic
2121 growth, including services related to education, transportation,
2222 public safety, recreation, health care, training, community
2323 planning, or employment.
2424 (b) The District may sponsor and participate in an economic
2525 development program intended to strengthen the economic base and
2626 further the economic development of this state. A determination by
2727 the Board of Directors that an economic development program is
2828 intended and expected to accomplish the program's stated purposes
2929 is conclusive with respect to whether the program serves the
3030 purposes of this section.
3131 (c) An economic development program must be within:
3232 (1) the territorial boundaries of the District; or
3333 (2) the District's water service area.
3434 (d) An economic development program may be established only
3535 by formal action of the Board of Directors. The Board of Directors
3636 shall:
3737 (1) establish the goals of the program;
3838 (2) impose requirements on persons participating in or
3939 receiving a benefit from the program; and
4040 (3) provide restrictions, procedures, and budget
4141 limits the Board of Directors determines are necessary to ensure
4242 that the governmental purposes of this section and the program are
4343 achieved.
4444 (e) An economic development program may involve the
4545 granting or lending of money, services, or property to a person
4646 engaged in an economic development activity.
4747 (f) The District may:
4848 (1) employ staff and spend its resources, other than
4949 money received from an ad valorem tax or a general appropriation, to
5050 further an economic development program; and
5151 (2) apply for and receive money, grants, or other
5252 assistance from any source to implement an economic development
5353 program.
5454 (g) The District and any public or private person may enter
5555 into an agreement with respect to an economic development program.
5656 (h) If the District proposes to provide scholarships,
5757 grants, loans, or financial assistance to a public fire-fighting
5858 organization, the District shall adopt guidelines for determining:
5959 (1) eligibility for the assistance;
6060 (2) the amount of any loan, grant, or other assistance
6161 the District may provide; and
6262 (3) the types of equipment, facilities, education, or
6363 training for which the assistance may be used.
6464 SECTION 2. The legislature finds that the economic
6565 development programs authorized by Section 11, Chapter 186, Acts of
6666 the 50th Legislature, Regular Session, 1947, as added by this Act,
6767 are a specific public purpose and governmental function of the
6868 Lavaca-Navidad River Authority in accordance with:
6969 (1) Section 52-a, Article III, Texas Constitution; and
7070 (2) Section 59, Article XVI, Texas Constitution.
7171 SECTION 3. This Act takes effect September 1, 2011.
