77 relating to the authority of the El Paso County Hospital District to
88 employ and commission peace officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (a), Section 281.057, Health and
1111 Safety Code, is amended to read as follows:
1212 (a) The board of the Dallas County Hospital District, the
1313 Tarrant County Hospital District, [or] the Bexar County Hospital
1414 District, or the El Paso County Hospital District may employ and
1515 commission peace officers for the district.
1616 SECTION 2. Article 2.12, Code of Criminal Procedure, is
1717 amended to read as follows:
1818 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1919 officers:
2020 (1) sheriffs, their deputies, and those reserve
2121 deputies who hold a permanent peace officer license issued under
2222 Chapter 1701, Occupations Code;
2323 (2) constables, deputy constables, and those reserve
2424 deputy constables who hold a permanent peace officer license issued
2525 under Chapter 1701, Occupations Code;
2626 (3) marshals or police officers of an incorporated
2727 city, town, or village, and those reserve municipal police officers
2828 who hold a permanent peace officer license issued under Chapter
2929 1701, Occupations Code;
3030 (4) rangers and officers commissioned by the Public
3131 Safety Commission and the Director of the Department of Public
3232 Safety;
3333 (5) investigators of the district attorneys', criminal
3434 district attorneys', and county attorneys' offices;
3535 (6) law enforcement agents of the Texas Alcoholic
3636 Beverage Commission;
3737 (7) each member of an arson investigating unit
3838 commissioned by a city, a county, or the state;
3939 (8) officers commissioned under Section 37.081,
4040 Education Code, or Subchapter E, Chapter 51, Education Code;
4141 (9) officers commissioned by the General Services
4242 Commission;
4343 (10) law enforcement officers commissioned by the
4444 Parks and Wildlife Commission;
4545 (11) airport police officers commissioned by a city
4646 with a population of more than 1.18 million that operates an airport
4747 that serves commercial air carriers;
4848 (12) airport security personnel commissioned as peace
4949 officers by the governing body of any political subdivision of this
5050 state, other than a city described by Subdivision (11), that
5151 operates an airport that serves commercial air carriers;
5252 (13) municipal park and recreational patrolmen and
5353 security officers;
5454 (14) security officers and investigators commissioned
5555 as peace officers by the comptroller;
5656 (15) officers commissioned by a water control and
5757 improvement district under Section 49.216, Water Code;
5858 (16) officers commissioned by a board of trustees
5959 under Chapter 54, Transportation Code;
6060 (17) investigators commissioned by the Texas Medical
6161 Board;
6262 (18) officers commissioned by the board of managers of
6363 the Dallas County Hospital District, the Tarrant County Hospital
6464 District, [or] the Bexar County Hospital District, or the El Paso
6565 County Hospital District under Section 281.057, Health and Safety
6666 Code;
6767 (19) county park rangers commissioned under
6868 Subchapter E, Chapter 351, Local Government Code;
6969 (20) investigators employed by the Texas Racing
7070 Commission;
7171 (21) officers commissioned under Chapter 554,
7272 Occupations Code;
7373 (22) officers commissioned by the governing body of a
7474 metropolitan rapid transit authority under Section 451.108,
7575 Transportation Code, or by a regional transportation authority
7676 under Section 452.110, Transportation Code;
7777 (23) investigators commissioned by the attorney
7878 general under Section 402.009, Government Code;
7979 (24) security officers and investigators commissioned
8080 as peace officers under Chapter 466, Government Code;
8181 (25) an officer employed by the Department of State
8282 Health Services under Section 431.2471, Health and Safety Code;
8383 (26) officers appointed by an appellate court under
8484 Subchapter F, Chapter 53, Government Code;
8585 (27) officers commissioned by the state fire marshal
8686 under Chapter 417, Government Code;
8787 (28) an investigator commissioned by the commissioner
8888 of insurance under Section 701.104, Insurance Code;
8989 (29) apprehension specialists and inspectors general
9090 commissioned by the Texas Youth Commission as officers under
9191 Sections 61.0451 and 61.0931, Human Resources Code;
9292 (30) officers appointed by the inspector general of
9393 the Texas Department of Criminal Justice under Section 493.019,
9494 Government Code;
9595 (31) investigators commissioned by the Commission on
9696 Law Enforcement Officer Standards and Education under Section
9797 1701.160, Occupations Code;
9898 (32) commission investigators commissioned by the
9999 Texas Private Security Board under Section 1702.061(f),
100100 Occupations Code;
101101 (33) the fire marshal and any officers, inspectors, or
102102 investigators commissioned by an emergency services district under
103103 Chapter 775, Health and Safety Code;
104104 (34) officers commissioned by the State Board of
105105 Dental Examiners under Section 254.013, Occupations Code, subject
106106 to the limitations imposed by that section;
107107 (35) investigators commissioned by the Texas Juvenile
108108 Probation Commission as officers under Section 141.055, Human
109109 Resources Code; and
110110 (36) the fire marshal and any related officers,
111111 inspectors, or investigators commissioned by a county under
112112 Subchapter B, Chapter 352, Local Government Code.
113113 SECTION 3. This Act takes effect immediately if it receives
114114 a vote of two-thirds of all the members elected to each house, as
115115 provided by Section 39, Article III, Texas Constitution. If this
116116 Act does not receive the vote necessary for immediate effect, this
117117 Act takes effect September 1, 2011.
