10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. The heading to Article 45.056, Code of Criminal |
---|
12 | 12 | | Procedure, is amended to read as follows: |
---|
13 | 13 | | Art. 45.056. [AUTHORITY TO EMPLOY] JUVENILE CASE MANAGERS[; |
---|
14 | 14 | | REIMBURSEMENT]. |
---|
15 | 15 | | SECTION 2. Article 45.056, Code of Criminal Procedure, is |
---|
16 | 16 | | amended by amending Subsection (d) and adding Subsections (f), (g), |
---|
17 | 17 | | and (h) to read as follows: |
---|
18 | 18 | | (d) Pursuant to Article 102.0174, the court or governing |
---|
19 | 19 | | body may pay the salary and benefits of a juvenile case manager and |
---|
20 | 20 | | the costs of training, travel, office supplies, and other necessary |
---|
21 | 21 | | expenses relating to the position of the juvenile case manager from |
---|
22 | 22 | | the juvenile case manager fund. |
---|
23 | 23 | | (f) The governing body of the employing governmental entity |
---|
24 | 24 | | under Subsection (a) shall adopt reasonable rules for juvenile case |
---|
25 | 25 | | managers that provide: |
---|
26 | 26 | | (1) a code of ethics, and for the enforcement of the |
---|
27 | 27 | | code of ethics; |
---|
28 | 28 | | (2) appropriate educational preservice and in-service |
---|
29 | 29 | | training standards for juvenile case managers; and |
---|
30 | 30 | | (3) training in: |
---|
31 | 31 | | (A) the role of the juvenile case manager; |
---|
32 | 32 | | (B) case planning and management; |
---|
33 | 33 | | (C) applicable procedural and substantive law; |
---|
34 | 34 | | (D) courtroom proceedings and presentation; |
---|
35 | 35 | | (E) services to at-risk youth under Subchapter D, |
---|
36 | 36 | | Chapter 264, Family Code; |
---|
37 | 37 | | (F) local programs and services for juveniles and |
---|
38 | 38 | | methods by which juveniles may access those programs and services; |
---|
39 | 39 | | and |
---|
40 | 40 | | (G) detecting and preventing abuse, |
---|
41 | 41 | | exploitation, and neglect of juveniles. |
---|
42 | 42 | | (g) The employing court or governmental entity under this |
---|
43 | 43 | | article shall implement the rules adopted under Subsection (f). |
---|
44 | 44 | | (h) The commissioners court or governing body of the |
---|
45 | 45 | | municipality that administers a juvenile case manager fund under |
---|
46 | 46 | | Article 102.0174 shall require periodic review of juvenile case |
---|
47 | 47 | | managers to ensure the implementation of the rules adopted under |
---|
48 | 48 | | Subsection (f). |
---|
49 | 49 | | SECTION 3. Article 102.0174(g), Code of Criminal Procedure, |
---|
50 | 50 | | is amended to read as follows: |
---|
51 | 51 | | (g) A fund created under this section may be used only to |
---|
52 | 52 | | finance the salary, [and] benefits, training, travel expenses, |
---|
53 | 53 | | office supplies, and other necessary expenses relating to the |
---|
54 | 54 | | position of a juvenile case manager employed under Article 45.056. |
---|
55 | 55 | | The fund may not be used to supplement the income of an employee |
---|
56 | 56 | | whose primary role is not that of a juvenile case manager. |
---|
57 | 57 | | SECTION 4. Not later than December 1, 2011, the governing |
---|
58 | 58 | | body of a governmental entity that employs a juvenile case manager |
---|
59 | 59 | | under Article 45.056, Code of Criminal Procedure, as amended by |
---|
60 | 60 | | this Act, shall adopt the rules required by that article. |
---|
61 | 61 | | SECTION 5. This Act takes effect immediately if it receives |
---|
62 | 62 | | a vote of two-thirds of all the members elected to each house, as |
---|
63 | 63 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
64 | 64 | | Act does not receive the vote necessary for immediate effect, this |
---|
65 | 65 | | Act takes effect September 1, 2011. |
