99 relating to juvenile case managers.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Article 45.056, Code of Criminal
1212 Procedure, is amended to read as follows:
1313 Art. 45.056. [AUTHORITY TO EMPLOY] JUVENILE CASE MANAGERS[;
1414 REIMBURSEMENT].
1515 SECTION 2. Article 45.056, Code of Criminal Procedure, is
1616 amended by amending Subsection (d) and adding Subsections (f), (g),
1717 and (h) to read as follows:
1818 (d) Pursuant to Article 102.0174, the court or governing
1919 body may pay the salary and benefits of a juvenile case manager and
2020 the costs of training, travel, office supplies, and other necessary
2121 expenses relating to the position of the juvenile case manager from
2222 the juvenile case manager fund.
2323 (f) The governing body of the employing governmental entity
2424 under Subsection (a) shall adopt reasonable rules for juvenile case
2525 managers that provide:
2626 (1) a code of ethics, and for the enforcement of the
2727 code of ethics;
2828 (2) appropriate educational preservice and in-service
2929 training standards for juvenile case managers; and
3030 (3) training in:
3131 (A) the role of the juvenile case manager;
3232 (B) case planning and management;
3333 (C) applicable procedural and substantive law;
3434 (D) courtroom proceedings and presentation;
3535 (E) services to at-risk youth under Subchapter D,
3636 Chapter 264, Family Code;
3737 (F) local programs and services for juveniles and
3838 methods by which juveniles may access those programs and services;
3939 and
4040 (G) detecting and preventing abuse,
4141 exploitation, and neglect of juveniles.
4242 (g) The employing court or governmental entity under this
4343 article shall implement the rules adopted under Subsection (f).
4444 (h) The commissioners court or governing body of the
4545 municipality that administers a juvenile case manager fund under
4646 Article 102.0174 shall require periodic review of juvenile case
4747 managers to ensure the implementation of the rules adopted under
4848 Subsection (f).
4949 SECTION 3. Article 102.0174(g), Code of Criminal Procedure,
5050 is amended to read as follows:
5151 (g) A fund created under this section may be used only to
5252 finance the salary, [and] benefits, training, travel expenses,
5353 office supplies, and other necessary expenses relating to the
5454 position of a juvenile case manager employed under Article 45.056.
5555 The fund may not be used to supplement the income of an employee
5656 whose primary role is not that of a juvenile case manager.
5757 SECTION 4. Not later than December 1, 2011, the governing
5858 body of a governmental entity that employs a juvenile case manager
5959 under Article 45.056, Code of Criminal Procedure, as amended by
6060 this Act, shall adopt the rules required by that article.
6161 SECTION 5. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2011.
