88 infrastructure project formerly known as TexasOnline.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (c-1), Article 45.0511, Code of
1111 Criminal Procedure, is amended to read as follows:
1212 (c-1) In this subsection, "state electronic Internet
1313 portal" ["TexasOnline"] has the meaning assigned by Section
1414 2054.003, Government Code. As an alternative to receiving the
1515 defendant's driving record under Subsection (c)(2), the judge, at
1616 the time the defendant requests a driving safety course or
1717 motorcycle operator training course dismissal under this article,
1818 may require the defendant to pay a fee in an amount equal to the sum
1919 of the amount of the fee established by Section 521.048,
2020 Transportation Code, and the state electronic Internet portal
2121 [TexasOnline] fee and, using the state electronic Internet portal
2222 [TexasOnline], may request the Texas Department of Public Safety to
2323 provide the judge with a copy of the defendant's driving record that
2424 shows the information described by Section 521.047(b),
2525 Transportation Code. As soon as practicable and using the state
2626 electronic Internet portal [TexasOnline], the Texas Department of
2727 Public Safety shall provide the judge with the requested copy of the
2828 defendant's driving record. The fee authorized by this subsection
2929 is in addition to any other fee required under this article. If the
3030 copy of the defendant's driving record provided to the judge under
3131 this subsection shows that the defendant has not completed an
3232 approved driving safety course or motorcycle operator training
3333 course, as appropriate, within the 12 months preceding the date of
3434 the offense, the judge shall allow the defendant to complete the
3535 appropriate course as provided by this article. The custodian of a
3636 municipal or county treasury who receives fees collected under this
3737 subsection shall keep a record of the fees and, without deduction or
3838 proration, forward the fees to the comptroller, with and in the
3939 manner required for other fees and costs received in connection
4040 with criminal cases. The comptroller shall credit fees received
4141 under this subsection to the Texas Department of Public Safety.
4242 SECTION 2. Subsection (b), Section 32.253, Education Code,
4343 is amended to read as follows:
4444 (b) The Department of Information Resources shall:
4545 (1) host the portal through the state electronic
4646 Internet portal project [known as TexasOnline];
4747 (2) organize the portal in a manner that simplifies
4848 portal use and administration;
4949 (3) provide any necessary technical advice to the
5050 agency, including advice relating to equipment required in
5151 connection with the portal;
5252 (4) provide a method for maintaining the information
5353 made available through the portal; and
5454 (5) cooperate with the agency in linking the agency's
5555 Internet site to the portal.
5656 SECTION 3. Section 103.021, Government Code, is amended to
5757 read as follows:
5858 Sec. 103.021. ADDITIONAL FEES AND COSTS IN CRIMINAL OR
5959 CIVIL CASES: CODE OF CRIMINAL PROCEDURE. An accused or defendant,
6060 or a party to a civil suit, as applicable, shall pay the following
6161 fees and costs under the Code of Criminal Procedure if ordered by
6262 the court or otherwise required:
6363 (1) a personal bond fee (Art. 17.42, Code of Criminal
6464 Procedure) . . . the greater of $20 or three percent of the amount
6565 of the bail fixed for the accused;
6666 (2) cost of electronic monitoring as a condition of
6767 release on personal bond (Art. 17.43, Code of Criminal Procedure)
6868 . . . actual cost;
6969 (3) a fee for verification of and monitoring of motor
7070 vehicle ignition interlock (Art. 17.441, Code of Criminal
7171 Procedure) . . . not to exceed $10;
7272 (4) repayment of reward paid by a crime stoppers

184184 SECTION 4. Subsection (i), Section 403.024, Government
185185 Code, is amended to read as follows:
186186 (i) The Department of Information Resources, after
187187 consultation with the comptroller, shall prominently include a link
188188 to the database established under this section on the public home
189189 page of the state electronic Internet portal project [TexasOnline
190190 Project] described by Section 2054.252.
191191 SECTION 5. Subdivision (2), Section 434.101, Government
192192 Code, is amended to read as follows:
193193 (2) "State electronic Internet portal"
194194 ["TexasOnline"] has the meaning assigned by Section 2054.003.
195195 SECTION 6. Subsection (a), Section 434.102, Government
196196 Code, is amended to read as follows:
197197 (a) The Department of Information Resources shall establish
198198 and maintain on the state electronic Internet portal [TexasOnline]
199199 a veterans website. The website must allow veterans to access
200200 information on state and federal veterans benefits programs.
201201 SECTION 7. Subsection (c), Section 441.010, Government
202202 Code, is amended to read as follows:
203203 (c) The department shall provide a link on the state
204204 electronic Internet portal [TexasOnline] to the database
205205 established under Subsection (b). In this subsection, "state
206206 electronic Internet portal" ["TexasOnline"] has the meaning
207207 assigned by Section 2054.003.
208208 SECTION 8. Subsection (d), Section 531.0313, Government
209209 Code, is amended to read as follows:
210210 (d) The Texas Information and Referral Network shall
211211 coordinate with the Department of Information Resources to maintain
212212 the Internet site through the state electronic Internet portal
213213 [TexasOnline] project established by the Department of Information
214214 Resources.
215215 SECTION 9. Subsection (b), Section 531.0317, Government
216216 Code, is amended to read as follows:
217217 (b) The commission, in cooperation with the Department of
218218 Information Resources, shall establish and maintain through the
219219 state electronic Internet portal [TexasOnline] project established
220220 by the Department of Information Resources a generally accessible
221221 and interactive Internet site that contains information for the
222222 public regarding the services and programs provided or administered
223223 by each of the health and human services agencies throughout the
224224 state. The commission shall establish the site in such a manner
225225 that it can be located easily through electronic means.
226226 SECTION 10. Subdivision (15), Section 2054.003, Government
227227 Code, is amended to read as follows:
228228 (15) "State electronic Internet portal"
229229 ["TexasOnline"] means the electronic government project or its
230230 successor project implemented under Subchapter I.
231231 SECTION 11. Subsection (b), Section 2054.055, Government
232232 Code, is amended to read as follows:
233233 (b) The report must:
234234 (1) assess the progress made toward meeting the goals
235235 and objectives of the state strategic plan for information
236236 resources management;
237237 (2) describe major accomplishments of the state or a
238238 specific state agency in information resources management;
239239 (3) describe major problems in information resources
240240 management confronting the state or a specific state agency;
241241 (4) provide a summary of the total expenditures for
242242 information resources and information resources technologies by
243243 the state;
244244 (5) make recommendations for improving the
245245 effectiveness and cost-efficiency of the state's use of information
246246 resources;
247247 (6) describe the status, progress, benefits, and
248248 efficiency gains of the state electronic Internet portal
249249 [TexasOnline] project, including any significant issues regarding
250250 contract performance;
251251 (7) provide a financial summary of the state
252252 electronic Internet portal [TexasOnline] project, including
253253 project costs and revenues;
254254 (8) provide a summary of the amount and use of
255255 Internet-based training conducted by each state agency and
256256 institution of higher education;
257257 (9) provide a summary of agency and statewide results
258258 in providing access to electronic and information resources to
259259 individuals with disabilities as required by Subchapter M; and
260260 (10) assess the progress made toward accomplishing the
261261 goals of the plan for a state telecommunications network and
262262 developing a system of telecommunications services as provided by
263263 Subchapter H.
264264 SECTION 12. The heading to Section 2054.111, Government
265265 Code, is amended to read as follows:

276276 payment methods, including the acceptance of credit and debit

278278 (1) point-of-sale transactions, including:
279279 (A) person-to-person transactions;
280280 (B) transactions that use an automated process to
281281 facilitate a person-to-person transaction; and
282282 (C) transactions completed by a person at an
283283 unattended self-standing computer station using an automated
284284 process;
285285 (2) telephone transactions; or
286286 (3) mail transactions.
287287 SECTION 15. Section 2054.113, Government Code, is amended
288288 to read as follows:
289289 Sec. 2054.113. DUPLICATION WITH STATE ELECTRONIC INTERNET
290290 PORTAL [TEXASONLINE]. (a) This section does not apply to a state
291291 agency that is a university system or institution of higher
292292 education as defined by Section 61.003, Education Code.
293293 (b) A state agency may not duplicate an infrastructure
294294 component of the state electronic Internet portal [TexasOnline],
295295 unless the department approves the duplication. In this
296296 subsection, "infrastructure" does not include the development of
297297 applications, and the supporting platform, for electronic
298298 government projects.
299299 (c) Before a state agency may contract with a third party
300300 for Internet application development that duplicates a state
301301 electronic Internet portal [TexasOnline] function, the state
302302 agency must notify the department of its intent to bid for such
303303 services at the same time that others have the opportunity to
304304 bid. The department may exempt a state agency from this section if
305305 it determines the agency has fully complied with Section 2054.111.
306306 SECTION 16. Subsection (e), Section 2054.116, Government
307307 Code, is amended to read as follows:
308308 (e) This section does not apply to interactive applications
309309 provided through the state electronic Internet portal
310310 [TexasOnline].
311311 SECTION 17. Subsection (d), Section 2054.125, Government
312312 Code, is amended to read as follows:
313313 (d) Each state agency that maintains a generally accessible
314314 Internet site and that uses the state electronic Internet portal
315315 [TexasOnline] shall include a link to the state electronic Internet
316316 portal [TexasOnline] on the front page of the Internet site.
317317 SECTION 18. Subsection (a), Section 2054.128, Government
318318 Code, is amended to read as follows:
319319 (a) State agencies that have jurisdiction over matters
320320 related to environmental protection or quality or to the
321321 development, conservation, or preservation of natural resources
322322 shall develop, in mutual cooperation with the department, a single
323323 information link, through the state electronic Internet
324324 [TexasOnline] portal, to provide electronic access to information
325325 and services related to the agencies' authority and duties,
326326 including access to agency rules and other public information.
327327 SECTION 19. Subsection (c), Section 2054.131, Government
328328 Code, is amended to read as follows:
329329 (c) The electronic infrastructure established under
330330 Subsection (a) may include the state electronic Internet portal
331331 [TexasOnline], the Internet, intranets, extranets, and wide area
332332 networks.

341341 SECTION 22. Subsection (a), Section 2054.252, Government
342342 Code, is amended to read as follows:
343343 (a) The department shall implement a state electronic
344344 Internet portal project [designated "TexasOnline"] that
345345 establishes a common electronic infrastructure through which state
346346 agencies and local governments, including licensing entities, may
347347 by any method:
348348 (1) send and receive documents or required payments to
349349 and from:
350350 (A) members of the public;
351351 (B) persons who are regulated by the agencies or
352352 local governments; and
353353 (C) the agencies and local governments;
354354 (2) receive applications for original and renewal
355355 licenses and permits, including occupational licenses, complaints
356356 about occupational license holders, and other documents for filing
357357 from members of the public and persons who are regulated by a state
358358 agency or local government that, when secure access is necessary,
359359 can be electronically validated by the agency, local government,
360360 member of the public, or regulated person;
361361 (3) send original and renewal occupational licenses to
362362 persons regulated by licensing entities;
363363 (4) send profiles of occupational license holders to
364364 persons regulated by licensing entities and to the public;
365365 (5) store information; and
366366 (6) provide and receive any other service to and from
367367 the agencies and local governments or the public.
368368 SECTION 23. Subsections (a) and (b), Section 2054.272,
369369 Government Code, are amended to read as follows:
370370 (a) A state agency that has jurisdiction over matters
371371 related to occupational licenses, including a licensing entity of
372372 this state, shall develop in cooperation with the department a link
373373 through the state electronic Internet [TexasOnline] portal.
374374 (b) The link shall provide streamlined access to each
375375 occupational license listed on the state electronic Internet portal
376376 [TexasOnline].
377377 SECTION 24. Subsection (c), Section 2054.355, Government
378378 Code, is amended to read as follows:
379379 (c) If the department uses the state electronic Internet
380380 portal [TexasOnline] to implement the system, the department may
381381 recover costs incurred under this section as provided by Section
382382 2054.252[, as added by Chapter 342, Acts of the 77th Legislature,
383383 Regular Session, 2001].
384384 SECTION 25. Subdivision (1), Section 2055.001, Government
385385 Code, is amended to read as follows:
386386 (1) "Board," "department," "electronic government
387387 project," "executive director," "local government," "major
388388 information resources project," "quality assurance team," and
389389 "state electronic Internet portal" ["TexasOnline"] have the
390390 meanings assigned by Section 2054.003.
391391 SECTION 26. Section 2055.202, Government Code, is amended
392392 to read as follows:
393393 Sec. 2055.202. ESTABLISHMENT OF PROJECT. The department
394394 shall establish an electronic government project to develop an
395395 Internet website accessible through the state electronic Internet
396396 portal [TexasOnline] that:
397397 (1) provides a single location for state agencies to
398398 post electronic summaries of state grant assistance opportunities
399399 with the state agencies;
400400 (2) enables a person to search for state grant
401401 assistance programs provided by state agencies;
402402 (3) allows, when feasible, electronic submission of
403403 state grant assistance applications;
404404 (4) improves the effectiveness and performance of
405405 state grant assistance programs;
406406 (5) streamlines and simplifies state grant assistance
407407 application and reporting processes; and
408408 (6) improves the delivery of services to the public.
409409 SECTION 27. Subsections (c), (c-1), and (c-3), Section
410410 105.003, Health and Safety Code, are amended to read as follows:
411411 (c) The Department of Information Resources, through the
412412 state electronic Internet portal [TexasOnline] and in consultation
413413 with the council and the Health Professions Council, shall add and
414414 label as "mandatory" the following fields on an application or
415415 renewal form for a license, certificate, or registration for a
416416 person subject to Subsection (c-2):
417417 (1) full name and last four digits of social security
418418 number;
419419 (2) full mailing address; and
420420 (3) educational background and training, including
421421 basic health professions degree, school name and location of basic
422422 health professions degree, and graduation year for basic health
423423 professions degree, and, as applicable, highest professional
424424 degree obtained, related professional school name and location, and
425425 related graduation year.
426426 (c-1) The Department of Information Resources, through the
427427 state electronic Internet portal [TexasOnline] and in consultation
428428 with the council and the Health Professions Council, shall add the
429429 following fields on an application or renewal form for a license,
430430 certificate, or registration for a person subject to Subsection
431431 (c-2):
432432 (1) date and place of birth;
433433 (2) sex;
434434 (3) race and ethnicity;
435435 (4) location of high school;
436436 (5) mailing address of primary practice;
437437 (6) number of hours per week spent at primary practice
438438 location;
439439 (7) description of primary practice setting;
440440 (8) primary practice information, including primary
441441 specialty practice, practice location zip code, and county; and
442442 (9) information regarding any additional practice,
443443 including description of practice setting, practice location zip
444444 code, and county.
445445 (c-3) The relevant members of the Health Professions
446446 Council shall encourage each person described by Subsection (c-2)
447447 licensed, certified, or registered under that council's authority
448448 to submit application and renewal information under Subsections (c)
449449 and (c-1) through the system developed by the Department of
450450 Information Resources and the state electronic Internet portal
451451 [TexasOnline].
452452 SECTION 28. Subsection (b), Section 431.202, Health and
453453 Safety Code, is amended to read as follows:
454454 (b) An applicant for a license under this subchapter must
455455 submit an application to the department on the form prescribed by
456456 the department or electronically on the state electronic Internet
457457 portal [TexasOnline Internet website].
458458 SECTION 29. Subsection (d), Section 431.206, Health and
459459 Safety Code, is amended to read as follows:
460460 (d) The notice and confirmation required by this section are
461461 deemed adequate if the licensee sends the notices by certified
462462 mail, return receipt requested, to the central office of the
463463 department or submits them electronically through the state
464464 electronic Internet portal [TexasOnline Internet website].
465465 SECTION 30. Subsection (d), Section 431.410, Health and
466466 Safety Code, is amended to read as follows:
467467 (d) The notice and confirmation required by this section are
468468 considered adequate if the license holder sends the notices by
469469 certified mail, return receipt requested, to the central office of
470470 the department or submits the notices electronically through the
471471 state electronic Internet portal [TexasOnline Internet website].
472472 SECTION 31. Section 548.258, Transportation Code, is
473473 amended to read as follows:
474474 Sec. 548.258. USE OF STATE ELECTRONIC INTERNET PORTAL
475475 [TEXASONLINE]. (a) In this section, "state electronic Internet
476476 portal" ["TexasOnline"] has the meaning assigned by Section
477477 2054.003, Government Code.
478478 (b) The department may adopt rules to require an inspection
479479 station to use the state electronic Internet portal [TexasOnline]
480480 to:
481481 (1) purchase inspection certificates; or
482482 (2) send to the department a record, report, or other
483483 information required by the department.
484484 SECTION 32. Subsection (a), Section 55.203, Utilities Code,
485485 is amended to read as follows:
486486 (a) A private for-profit publisher of a residential
487487 telephone directory that is distributed to the public at minimal or
488488 no cost shall include in the directory:
489489 (1) a listing of any toll-free and local telephone
490490 numbers of:
491491 (A) state agencies;
492492 (B) state public services; and
493493 (C) each state elected official who represents
494494 all or part of the geographical area for which the directory

500500 SECTION 33. This Act takes effect immediately if it
501501 receives a vote of two-thirds of all the members elected to each
502502 house, as provided by Section 39, Article III, Texas Constitution.
503503 If this Act does not receive the vote necessary for immediate
504504 effect, this Act takes effect September 1, 2011.
