66 AN ACT
77 relating to the transfer of the assets of and the dissolution of the
88 Fort Bend County Water Control and Improvement District No. 1.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "City" means the City of Sugar Land.
1212 (2) "District" means the Fort Bend County Water
1313 Control and Improvement District No. 1.
1414 SECTION 2. TRANSFER OF ASSETS AND DISSOLUTION OF DISTRICT.
1515 (a) On the date the city council of the city passes a resolution
1616 accepting the assets, debts, and contractual rights and obligations
1717 of the district:
1818 (1) all assets, debts, and contractual rights and
1919 obligations of the district are property of the city; and
2020 (2) the district is dissolved.
2121 (b) On the date of the dissolution of the district, and
2222 notwithstanding Section 51.790, Water Code, ownership of
2323 Certificate of Adjudication No. 11-5170, including any attachments
2424 or amendments to the certificate, transfers to the city.
2525 (c) The city shall notify the Texas Commission on
2626 Environmental Quality of the dissolution of the district and the
2727 transfer of Certificate of Adjudication No. 11-5170 to the city.
2828 (d) On receipt of notice under Subsection (c) of this
2929 section, the Texas Commission on Environmental Quality shall note
3030 in its records that Certificate of Adjudication No. 11-5170 is
3131 owned by the city. The Texas Commission on Environmental Quality
3232 shall, as a ministerial act, transfer the certificate to the city
3333 without further application, notice, or hearing. A person, party,
3434 or entity does not have any right of protest, objection, or
3535 administrative review of the transfer prescribed by this Act.
3636 (e) The transfer of Certificate of Adjudication No. 11-5170
3737 to the city does not affect or impair the priority, extent,
3838 validity, or purpose of the certificate.
3939 SECTION 3. EXPIRATION OF ACT. This Act expires September 1,
4040 2013.
4141 SECTION 4. EFFECTIVE DATE. This Act takes effect
4242 immediately if it receives a vote of two-thirds of all the members
4343 elected to each house, as provided by Section 39, Article III, Texas
4444 Constitution. If this Act does not receive the vote necessary for
4545 immediate effect, this Act takes effect September 1, 2011.
