1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the use of certain professional titles by
1313 psychologists.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subsection (b), Section 501.156, Occupations
1616 Code, is amended to read as follows:
1717 (b) The board may not include in rules to prohibit false,
1818 misleading, or deceptive practices by a person regulated by the
1919 board a rule that:
2020 (1) restricts the person's use of any advertising
2121 medium;
2222 (2) restricts the person's personal appearance or use
2323 of the person's voice in an advertisement;
2424 (3) relates to the size or duration of an
2525 advertisement by the person; [or]
2626 (4) restricts the use of a trade name in advertising by
2727 the person; or
2828 (5) restricts the use of a title in advertising by a
2929 person who is permitted to use that title by law.
3030 SECTION 2. Section 501.260, Occupations Code, is amended by
3131 adding Subsection (d) to read as follows:
3232 (d) A person who is licensed under this section and who
3333 holds a Nationally Certified School Psychologist credential may use
3434 the credential "Nationally Certified School Psychologist" and the
3535 title "Licensed Specialist in School Psychology."
3636 SECTION 3. This Act takes effect September 1, 2011.
