| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Subsection (b), Section 501.156, Occupations |
|---|
| 16 | 16 | | Code, is amended to read as follows: |
|---|
| 17 | 17 | | (b) The board may not include in rules to prohibit false, |
|---|
| 18 | 18 | | misleading, or deceptive practices by a person regulated by the |
|---|
| 19 | 19 | | board a rule that: |
|---|
| 20 | 20 | | (1) restricts the person's use of any advertising |
|---|
| 21 | 21 | | medium; |
|---|
| 22 | 22 | | (2) restricts the person's personal appearance or use |
|---|
| 23 | 23 | | of the person's voice in an advertisement; |
|---|
| 24 | 24 | | (3) relates to the size or duration of an |
|---|
| 25 | 25 | | advertisement by the person; [or] |
|---|
| 26 | 26 | | (4) restricts the use of a trade name in advertising by |
|---|
| 27 | 27 | | the person; or |
|---|
| 28 | 28 | | (5) restricts the use of a title in advertising by a |
|---|
| 29 | 29 | | person who is permitted to use that title by law. |

| 30 | 30 | | SECTION 2. Section 501.260, Occupations Code, is amended by |
|---|
| 31 | 31 | | adding Subsection (d) to read as follows: |
|---|
| 32 | 32 | | (d) A person who is licensed under this section and who |
|---|
| 33 | 33 | | holds a Nationally Certified School Psychologist credential may use |
|---|
| 34 | 34 | | the credential "Nationally Certified School Psychologist" and the |
|---|
| 35 | 35 | | title "Licensed Specialist in School Psychology." |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2011. |
