77 relating to the confidentiality of certain identifying information
88 regarding students of career schools or colleges and other
99 educational entities; providing a criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 132, Education Code, is
1212 amended by adding Section 132.024 to read as follows:
1313 Sec. 132.024. STUDENT INFORMATION; OFFENSE; PENALTY.
1414 (a) In this section:
1515 (1) "Student" means any prospective, current, or
1616 former student of:
1717 (A) a career school or college; or
1818 (B) any other school, educational institution,
1919 or business entity from which the commission receives, or regarding
2020 which the commission reviews, information through its
2121 administration or enforcement of this chapter.
2222 (2) "Student information" means identifying
2323 information in the commission's possession regarding a student.
2424 The term includes:
2525 (A) a student's name, address, telephone number,
2626 social security number, e-mail address, or date of birth;
2727 (B) any other identifying number or other
2828 information that foreseeably could be combined with other publicly
2929 available information to reveal identifying information regarding
3030 the student; and
3131 (C) a student's education records, as defined by
3232 34 C.F.R. Section 99.3.
3333 (b) Student information is not public information for
3434 purposes of Chapter 552, Government Code.
3535 (c) Unless permitted by Subchapter F, Chapter 301, Labor
3636 Code, or commission rule, a person commits an offense if the person
3737 solicits, discloses, receives, or uses, or authorizes, permits,
3838 participates in, or acquiesces in another person's use of, student
3939 information.
4040 (d) An offense under Subsection (c) is a Class A
4141 misdemeanor.
4242 SECTION 2. This Act takes effect September 1, 2011.
