| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 111.001, Family Code, is amended to read |
|---|
| 10 | 10 | | as follows: |
|---|
| 11 | 11 | | Sec. 111.001. REVIEW OF GUIDELINES. (a) Prior to each |
|---|
| 12 | 12 | | regular legislative session, the standing committees of each house |
|---|
| 13 | 13 | | of the legislature having jurisdiction over family law issues shall |
|---|
| 14 | 14 | | review and, if necessary, recommend revisions to the guidelines for |
|---|
| 15 | 15 | | possession of and access to a child under Chapter 153 [and for |
|---|
| 16 | 16 | | support of a child under Chapter 154]. The committee shall report |
|---|
| 17 | 17 | | the results of the review and shall include any recommended |
|---|
| 18 | 18 | | revisions in the committee's report to the legislature. |
|---|
| 19 | 19 | | (b) At least once every four years [Not later than December |
|---|
| 20 | 20 | | 1 of each even-numbered year], the Title IV-D agency shall review |
|---|
| 21 | 21 | | the child support guidelines under Chapter 154 as required by 42 |
|---|
| 22 | 22 | | U.S.C. Section 667(a) and report the results of the review and any |
|---|
| 23 | 23 | | recommendations for any changes to the guidelines and their manner |
|---|
| 24 | 24 | | of application [submit a report] to the standing committees of each |
|---|
| 25 | 25 | | house of the legislature having jurisdiction over family law issues |
|---|
| 26 | 26 | | [for use by the committee in conducting the review required by |
|---|
| 27 | 27 | | Subsection (a). The report must contain: |
|---|
| 28 | 28 | | [(1) economic data obtained from the United States |
|---|
| 29 | 29 | | Department of Agriculture on the cost of raising children; |
|---|
| 30 | 30 | | [(2) an analysis of case data on the application of and |
|---|
| 31 | 31 | | deviations from the child support guidelines; and |
|---|
| 32 | 32 | | [(3) a summary of any federal legislation enacted |
|---|
| 33 | 33 | | since the date of the last review]. |
|---|
| 34 | 34 | | SECTION 2. Not later than January 1, 2013, the Title IV-D |
|---|
| 35 | 35 | | agency shall submit the initial report required by Subsection (b), |
|---|
| 36 | 36 | | Section 111.001, Family Code, as amended by this Act. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2011. |
