9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 36.118, Water Code, is amended by adding | |
11 | 11 | Subsections (e-1) and (e-2) to read as follows: | |
12 | 12 | (e-1) Except as provided by Subsection (e-2), in addition to | |
13 | 13 | other remedies provided by law, the district is entitled to recover | |
14 | 14 | the district's attorney's fees, court costs, and reasonable | |
15 | 15 | expenses incurred in closing or capping the well from the owner of | |
16 | 16 | the land on which the well is located. | |
17 | 17 | (e-2) An entity that drills a well to develop subsurface | |
18 | 18 | resources not owned by the landowner is liable for expenses | |
19 | 19 | incurred in closing or capping the well, unless the landowner | |
20 | 20 | assumes responsibility for the well. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2011. |
