77 relating to a groundwater conservation district's recovery of
88 expenses in closing or capping a well.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 36.118, Water Code, is amended by adding
1111 Subsections (e-1) and (e-2) to read as follows:
1212 (e-1) Except as provided by Subsection (e-2), in addition to
1313 other remedies provided by law, the district is entitled to recover
1414 the district's attorney's fees, court costs, and reasonable
1515 expenses incurred in closing or capping the well from the owner of
1616 the land on which the well is located.
1717 (e-2) An entity that drills a well to develop subsurface
1818 resources not owned by the landowner is liable for expenses
1919 incurred in closing or capping the well, unless the landowner
2020 assumes responsibility for the well.
2121 SECTION 2. This Act takes effect September 1, 2011.
