| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 11, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 11.178 to read as follows: |
|---|
| 12 | 12 | | Sec. 11.178. PROHIBITION AGAINST USE OF SCHOOL DISTRICT |
|---|
| 13 | 13 | | RESOURCES FOR HOTEL. (a) In this section, "hotel" means a |
|---|
| 14 | 14 | | building in which members of the public obtain sleeping |
|---|
| 15 | 15 | | accommodations for consideration. The term includes a motel. |
|---|
| 16 | 16 | | (b) The board of trustees of an independent school district |
|---|
| 17 | 17 | | may not impose taxes, issue bonds, use or authorize the use of |
|---|
| 18 | 18 | | school district employees, use or authorize the use of school |
|---|
| 19 | 19 | | district property, money, or other resources, or acquire property |
|---|
| 20 | 20 | | for the design, construction, renovation, or operation of a hotel. |
|---|
| 21 | 21 | | (c) The board of trustees of an independent school district |
|---|
| 22 | 22 | | may not enter into a lease, contract, or other agreement that: |
|---|
| 23 | 23 | | (1) obligates the board to engage in an activity |
|---|
| 24 | 24 | | prohibited by Subsection (b); or |
|---|
| 25 | 25 | | (2) obligates the use of district employees or |
|---|
| 26 | 26 | | resources in a manner prohibited by Subsection (b). |
|---|
| 27 | 27 | | SECTION 2. Subsection (c), Section 11.178, Education Code, |
|---|
| 28 | 28 | | as added by this Act, applies only to an agreement concerning the |
|---|
| 29 | 29 | | use of school district resources for a hotel that is entered into on |
|---|
| 30 | 30 | | or after the effective date of this Act. An agreement concerning |
|---|
| 31 | 31 | | the use of school district resources for a hotel that is entered |
|---|
| 32 | 32 | | into before the effective date of this Act is governed by the law in |
|---|
| 33 | 33 | | effect on the date the agreement was entered into, and that law is |
|---|
| 34 | 34 | | continued in effect for that purpose. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2011. |
|---|
