77 relating to a prohibition against use of school district resources

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 11, Education Code, is
1111 amended by adding Section 11.178 to read as follows:
1212 Sec. 11.178. PROHIBITION AGAINST USE OF SCHOOL DISTRICT
1313 RESOURCES FOR HOTEL. (a) In this section, "hotel" means a
1414 building in which members of the public obtain sleeping
1515 accommodations for consideration. The term includes a motel.
1616 (b) The board of trustees of an independent school district
1717 may not impose taxes, issue bonds, use or authorize the use of
1818 school district employees, use or authorize the use of school
1919 district property, money, or other resources, or acquire property
2020 for the design, construction, renovation, or operation of a hotel.
2121 (c) The board of trustees of an independent school district
2222 may not enter into a lease, contract, or other agreement that:
2323 (1) obligates the board to engage in an activity
2424 prohibited by Subsection (b); or
2525 (2) obligates the use of district employees or
2626 resources in a manner prohibited by Subsection (b).
2727 SECTION 2. Subsection (c), Section 11.178, Education Code,
2828 as added by this Act, applies only to an agreement concerning the
2929 use of school district resources for a hotel that is entered into on
3030 or after the effective date of this Act. An agreement concerning
3131 the use of school district resources for a hotel that is entered
3232 into before the effective date of this Act is governed by the law in
3333 effect on the date the agreement was entered into, and that law is
3434 continued in effect for that purpose.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2011.
