A BILL TO BE ENTITLED
AN ACT
relating to the territory of the El Paso County Water Control and
Improvement District No. 4.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 58, Acts of the 54th Legislature,
Regular Session, 1955, is amended by adding Section 2A to read as
follows:
Sec. 2A. (a) In this section, "district" means the El Paso
County Water Control and Improvement District No. 4.
(b) The district is composed of the territory described by
Subsection (d) of this section.
(c) The boundaries and field notes contained in Subsection
(d) of this section form a closure. A mistake made in the field
notes or in copying the field notes in the legislative process does
not affect the district's:
(1) organization, existence, or validity;
(2) right to issue any type of bond for the purposes
for which the district is created or to pay the principal of and
interest on a bond;
(3) right to impose a tax; or
(4) legality or operation.
(d) The district includes all of the territory in the
following area:
COMMENCING FOR REFERENCE at a County Monument at the centerline
intersection of West Main Street (U.S. Highway No. 1) and 6th Street
in the Riverside Addition;
THENCE, along the centerline of said West Main Street, North
39°44'00" West, a distance of 165.81 feet to the POINT OF BEGINNING
for the herein described Tract;
THENCE, leaving said centerline, North 66°18'00" East, a distance of
52.00 feet to a point for corner in the northerly right-of-way line
of said West Main Street;
THENCE, along said right-of-way line, North 39°44'00" West, a
distance of 1,900.02 feet to a found 1/2-inch rebar at the
northwesterly corner of Tract 11A, Block 1, San Elizario Grant;
THENCE, along the north line of said Tract 11A, North 45°42'00"
East, a distance of 1,111.48 feet to a found 1/2-inch rebar at the
northeast corner of said Tract 11A in the westerly right-of-way
line of the G.H. & S.A. Railroad;
THENCE, along said west right-of-way line, South 29°19'00" East, a
distance of 2,053.86 feet to a set 1/2-inch rebar for corner;
THENCE, leaving said right-of-way line, North 60°41'00" East, a
distance of 100.00 feet to a set 1/2-inch rebar in the east
right-of-way line of said G.H. & S.A. Railroad at the northwest
corner of Tract 8, said Block 1;
THENCE, along the north line of Tracts 8 and 7, in said Block 1,
North 76°25'00" East, a distance of 817.29 feet to a set 1/2-inch
rebar in the east right-of-way line of North Loop Road;
THENCE, along said right-of-way line, South 04°49'00" West, a
distance of 576.41 feet to a set 1/2-inch rebar at the intersection
of said east right-of-way line of North Loop Road with the west
right-of-way line of 5th Street;
THENCE, along said west right-of-way line of 5th Street, North
50°32'00" East, a distance of 1,536.77 feet to a set 1/2-inch rebar
for corner in the northeast line of Block 6, Marchbanks Addition
Unit Two;
THENCE, along said northeast line, South 39°46'00" East, a distance
of 387.00 feet to a set 1/2-inch rebar for corner in the
northwesterly right-of-way line of I Avenue;
THENCE, North 50°14'00" East, along the northerly line of Park
Addition, a distance of 955.56 feet to a set 1/2-inch rebar for
corner;
THENCE, South 37°30'00" East, a distance of 746.33 feet to the
northwest corner of Lot 6, Park Addition No. 2 in the easterly
right-of-way line of CCC Camp Road;
THENCE, along the north line of said Lot 6, North 53°44'00" East, a
distance of 264.20 feet to the northeast corner of said Lot 6;
THENCE, along the east line of said Lots 6 and 7, South 37°30'00"
East, a distance of 182.81 feet to a chain link fence for corner;
THENCE, North 52°15'00" East, a distance of 546.21 feet to a found
1/2-inch rebar for corner;
THENCE, South 36°38'00" East, a distance of 399.71 feet to a point

THENCE, North 50°4'09" East, a distance of 157.40 feet to a point for
corner;
THENCE, South 36°38'00" East, a distance of 291.60 feet to a set
1/2-inch rebar for corner in the south right-of-way line of North
Fabens Street (Highway 793);
THENCE, along said south right-of-way line, North 50°14'00" East, a
distance of 192.02 feet to a set 1/2-inch rebar for corner in the
west right-of-way line of Lettunich Street;
THENCE, along said west right-of-way line, south 39°46'00" East, a
distance of 1,109.97 feet to a point for corner in the south
right-of-way line of the San Felipe Arroyo;
THENCE, along said south right-of-way line, the following two
courses:
North 68°30'00" East, a distance of 161.56 feet to a point;
North 71°53'36" East, a distance of 473.83 feet to the
northeast corner of Lot 9, Block 6, Loma Verde Subdivision Unit Two
and in the westerly line of Block L, University Land;
THENCE, along the westerly line of said Block L, South 00°11'00"
West, a distance of 2,919.41 feet to a found 1/2-inch rebar in
concrete at the northeast corner of Lot 2, Block 1, Stirman Hills
Subdivision;
THENCE, along the northeast line of said Block 1, South 41°48'00"
East, a distance of 1,858.07 feet to the southeast corner of Lot 31,
Block 1, Stirman Hills Subdivision;
THENCE, along the south line of said Block 1, South 43°16'00" West, a
distance of 758.43 feet to a found 1-inch pipe at the southwest
corner of Lot 42, said Block 1;
THENCE, North 41°48'00" West, a distance of 299.80 feet to a point in
the northerly right-of-way line of Cypress Street;
THENCE, along said north right-of-way line, South 43°30'00" West, a
distance of 2,224.11 feet to a set 1/2-inch rebar for corner at the
intersection of the north right-of-way line of said Cypress Street
at the east right-of-way line of the G.H. & S.A. Railroad;
THENCE, along the east right-of-way line of said railroad, North
46°13'00" West, a distance of 1,059.80 feet to a set 1/2-inch rebar
for corner at the intersection of the southerly right-of-way line
of Franklin Street extended to the east right-of-way line of said
railroad;
THENCE, along the extension of said Franklin Street, South 43°47'00"
West, a distance of 336.06 feet to a set 1/2-inch rebar on the
easterly bank of the Tornillo Canal;
THENCE, along the east bank of said Tornillo Canal the following
four courses:
North 50°24'02" West, a distance of 419.45 feet to a set
1/2-inch rebar;
North 47°25'47" West, a distance of 797.57 feet to a set
1/2-inch rebar at the beginning of a curve to the left;
Along the arc of said curve (Delta Angle = 46°45'34", Radius =
185.05 feet, Chord = North 70°48'34" West, 146.86 feet) a distance
of 151.02 feet to a set 1/2-inch rebar;
South 86°02'04" West, a distance of 850.85 feet to a set
1/2-inch rebar on a north bank of the River Drain outlet;
THENCE, along the northeasterly bank of said River Drain Outlet the
following five courses:
North 51°27'37" West, a distance of 684.08 feet to a set 1/2-inch
rebar;
North 28°34'07" West, a distance of 307.91 feet to a set 1/2-inch
rebar;
North 13°37'04" West, a distance of 464.61 feet to a set 1/2-inch
rebar at the beginning of a curve to the left;
Along the arc of said curve (Delta Angle = 22°28'12", Radius =
1,459.92 feet, Chord = North 24°51'10" West, 568.88 feet) a distance
of 572.55 feet to a set 1/2-inch rebar;
North 36°05'16" West, a distance of 744.35 feet to a set 1/2-inch
rebar on the south right-of-way line of south Fabens Street
(Highway 76);
THENCE, along said south right-of-way line the following four
courses:
South 50°14'00" West, a distance of 452.20 feet to a point;
North 85°23'00" West, a distance of 77.30 feet to a point;
North 79°43'00" West, a distance of 200.72 feet to a point;
South 89°02'00" West, a distance of 215.00 feet to a set 1/2-inch
rebar;
THENCE, leaving said south right-of-way line and along the west
line of the Hunts Addition, North 37°22'10" West, a distance of
1,683.25 feet to a set 1/2-inch rebar in the west right-of-way line
of the I-243 Lateral;
THENCE, North 26°28'18" West, a distance of 1,125.86 feet to a set
1/2-inch rebar in the north line of the Riverside Addition;
THENCE, along said north line, North 66°18'00" East, a distance of
992.89 feet to the POINT OF BEGINNING and containing 885.93 acres of
land.
SECTION 2. (a) The legal notice of the intention to
introduce this Act, setting forth the general substance of this
Act, has been published as provided by law, and the notice and a
copy of this Act have been furnished to all persons, agencies,
officials, or entities to which they are required to be furnished
under Section 59, Article XVI, Texas Constitution, and Chapter 313,
Government Code.
(b) The governor, one of the required recipients, has
submitted the notice and Act to the Texas Commission on
Environmental Quality.
(c) The Texas Commission on Environmental Quality has filed
its recommendations relating to this Act with the governor, the
lieutenant governor, and the speaker of the house of
representatives within the required time.
(d) All requirements of the constitution and laws of this
state and the rules and procedures of the legislature with respect
to the notice, introduction, and passage of this Act are fulfilled
and accomplished.
SECTION 3. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
