7	7	relating to the territory of the El Paso County Water Control and
8	8	Improvement District No. 4.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Chapter 58, Acts of the 54th Legislature,
11	11	Regular Session, 1955, is amended by adding Section 2A to read as
12	12	follows:
13	13	Sec. 2A. (a) In this section, "district" means the El Paso
14	14	County Water Control and Improvement District No. 4.
15	15	(b) The district is composed of the territory described by
16	16	Subsection (d) of this section.
17	17	(c) The boundaries and field notes contained in Subsection
18	18	(d) of this section form a closure. A mistake made in the field
19	19	notes or in copying the field notes in the legislative process does
20	20	not affect the district's:
21	21	(1) organization, existence, or validity;
22	22	(2) right to issue any type of bond for the purposes
23	23	for which the district is created or to pay the principal of and
24	24	interest on a bond;
25	25	(3) right to impose a tax; or
26	26	(4) legality or operation.
27	27	(d) The district includes all of the territory in the
28	28	following area:
29	29	COMMENCING FOR REFERENCE at a County Monument at the centerline
30	30	intersection of West Main Street (U.S. Highway No. 1) and 6th Street
31	31	in the Riverside Addition;
32	32	THENCE, along the centerline of said West Main Street, North
33	33	39°44'00" West, a distance of 165.81 feet to the POINT OF BEGINNING
34	34	for the herein described Tract;
35	35	THENCE, leaving said centerline, North 66°18'00" East, a distance of
36	36	52.00 feet to a point for corner in the northerly right-of-way line
37	37	of said West Main Street;
38	38	THENCE, along said right-of-way line, North 39°44'00" West, a
39	39	distance of 1,900.02 feet to a found 1/2-inch rebar at the
40	40	northwesterly corner of Tract 11A, Block 1, San Elizario Grant;

161	161	SECTION 2. (a) The legal notice of the intention to
162	162	introduce this Act, setting forth the general substance of this
163	163	Act, has been published as provided by law, and the notice and a
164	164	copy of this Act have been furnished to all persons, agencies,
165	165	officials, or entities to which they are required to be furnished
166	166	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
167	167	Government Code.
168	168	(b) The governor, one of the required recipients, has
169	169	submitted the notice and Act to the Texas Commission on
170	170	Environmental Quality.
171	171	(c) The Texas Commission on Environmental Quality has filed
172	172	its recommendations relating to this Act with the governor, the
173	173	lieutenant governor, and the speaker of the house of
174	174	representatives within the required time.
175	175	(d) All requirements of the constitution and laws of this
176	176	state and the rules and procedures of the legislature with respect
177	177	to the notice, introduction, and passage of this Act are fulfilled
178	178	and accomplished.
179	179	SECTION 3. This Act takes effect immediately if it receives
180	180	a vote of two-thirds of all the members elected to each house, as
181	181	provided by Section 39, Article III, Texas Constitution. If this
182	182	Act does not receive the vote necessary for immediate effect, this
183	183	Act takes effect September 1, 2011.
