| 7 | 7 | | relating to the contents and applicability of a school district's |

| 8 | 8 | | grading policy. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 28.0216, Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 28.0216. DISTRICT GRADING POLICY. (a) Before each |
|---|
| 13 | 13 | | school year, a [A] school district shall adopt a grading policy, |
|---|
| 14 | 14 | | including provisions for the assignment of grades on class |
|---|
| 15 | 15 | | assignments and examinations and the calculation of cumulative |
|---|
| 16 | 16 | | averages of grades[, before each school year]. A district grading |
|---|
| 17 | 17 | | policy: |
|---|
| 18 | 18 | | (1) must require a [classroom] teacher to assign a |
|---|
| 19 | 19 | | grade that reflects the student's relative mastery of the subject |
|---|
| 20 | 20 | | without employing grade inflation or misrepresenting a student's |
|---|
| 21 | 21 | | deserved grade [an assignment]; |
|---|
| 22 | 22 | | (2) may not require a [classroom] teacher to assign a |
|---|
| 23 | 23 | | minimum grade [for an assignment] without regard to the student's |
|---|
| 24 | 24 | | quality of work; and |
|---|
| 25 | 25 | | (3) may allow a student a reasonable opportunity to |
|---|
| 26 | 26 | | make up or redo a class assignment or examination for which the |
|---|
| 27 | 27 | | student received a failing grade. |
|---|
| 28 | 28 | | (b) A district grading policy shall apply to the assignment |
|---|
| 29 | 29 | | of a grade for which written notice is required under Section |
|---|
| 30 | 30 | | 28.022(a)(2), in addition to any other grade assigned by the |
|---|
| 31 | 31 | | district. |
|---|
| 32 | 32 | | SECTION 2. This Act applies beginning with the 2011-2012 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2011. |
