77 relating to the contents and applicability of a school district's
88 grading policy.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.0216, Education Code, is amended to
1111 read as follows:
1212 Sec. 28.0216. DISTRICT GRADING POLICY. (a) Before each
1313 school year, a [A] school district shall adopt a grading policy,
1414 including provisions for the assignment of grades on class
1515 assignments and examinations and the calculation of cumulative
1616 averages of grades[, before each school year]. A district grading
1717 policy:
1818 (1) must require a [classroom] teacher to assign a
1919 grade that reflects the student's relative mastery of the subject
2020 without employing grade inflation or misrepresenting a student's
2121 deserved grade [an assignment];
2222 (2) may not require a [classroom] teacher to assign a
2323 minimum grade [for an assignment] without regard to the student's
2424 quality of work; and
2525 (3) may allow a student a reasonable opportunity to
2626 make up or redo a class assignment or examination for which the
2727 student received a failing grade.
2828 (b) A district grading policy shall apply to the assignment
2929 of a grade for which written notice is required under Section
3030 28.022(a)(2), in addition to any other grade assigned by the
3131 district.
3232 SECTION 2. This Act applies beginning with the 2011-2012
3333 school year.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2011.
