88 agencies of certain rules and rulemaking filings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (b), Section 22.004, Government Code,
1111 is amended to read as follows:
1212 (b) The supreme court from time to time may promulgate a
1313 specific rule or rules of civil procedure, or an amendment or
1414 amendments to a specific rule or rules, to be effective at the time
1515 the supreme court deems expedient in the interest of a proper
1616 administration of justice. The rules and amendments to rules
1717 remain in effect unless and until disapproved by the legislature.
1818 The clerk of the supreme court shall file with the secretary of
1919 state the rules or amendments to rules promulgated by the supreme
2020 court under this subsection and shall mail a copy of those rules or
2121 amendments to rules to each registered member of the State Bar of
2222 Texas not later than the 60th day before the date on which they
2323 become effective. On receiving a written request from a member of
2424 the legislature, the [The] secretary of state shall provide the
2525 member with electronic notifications when the supreme court has
2626 promulgated rules or amendments to rules under this section [report
2727 the rules or amendments to rules to the next regular session of the
2828 legislature by mailing a copy of the rules or amendments to rules to
2929 each elected member of the legislature on or before December 1
3030 immediately preceding the session].
3131 SECTION 2. Subsection (b), Section 2001.032, Government
3232 Code, is amended to read as follows:
3333 (b) On receiving a written request from the lieutenant
3434 governor, a member of the legislature, or a legislative agency, the
3535 secretary of state shall provide the requestor with electronic
3636 notification of rulemaking filings by a state agency [A state
3737 agency shall deliver to the lieutenant governor and the speaker of
3838 the house of representatives a copy of the notice of a proposed rule
3939 when the agency files notice with the secretary of state] under
4040 Section 2001.023.
4141 SECTION 3. This Act takes effect September 1, 2011.
