| 7 | 7 | | relating to electronic notification of certain state officials and |

| 8 | 8 | | agencies of certain rules and rulemaking filings. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (b), Section 22.004, Government Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | (b) The supreme court from time to time may promulgate a |
|---|
| 13 | 13 | | specific rule or rules of civil procedure, or an amendment or |
|---|
| 14 | 14 | | amendments to a specific rule or rules, to be effective at the time |
|---|
| 15 | 15 | | the supreme court deems expedient in the interest of a proper |
|---|
| 16 | 16 | | administration of justice. The rules and amendments to rules |
|---|
| 17 | 17 | | remain in effect unless and until disapproved by the legislature. |
|---|
| 18 | 18 | | The clerk of the supreme court shall file with the secretary of |
|---|
| 19 | 19 | | state the rules or amendments to rules promulgated by the supreme |
|---|
| 20 | 20 | | court under this subsection and shall mail a copy of those rules or |
|---|
| 21 | 21 | | amendments to rules to each registered member of the State Bar of |
|---|
| 22 | 22 | | Texas not later than the 60th day before the date on which they |
|---|
| 23 | 23 | | become effective. On receiving a written request from a member of |
|---|
| 24 | 24 | | the legislature, the [The] secretary of state shall provide the |
|---|
| 25 | 25 | | member with electronic notifications when the supreme court has |
|---|
| 26 | 26 | | promulgated rules or amendments to rules under this section [report |
|---|
| 27 | 27 | | the rules or amendments to rules to the next regular session of the |

| 28 | 28 | | legislature by mailing a copy of the rules or amendments to rules to |
|---|
| 29 | 29 | | each elected member of the legislature on or before December 1 |

| 31 | 31 | | SECTION 2. Subsection (b), Section 2001.032, Government |
|---|
| 32 | 32 | | Code, is amended to read as follows: |
|---|
| 33 | 33 | | (b) On receiving a written request from the lieutenant |
|---|
| 34 | 34 | | governor, a member of the legislature, or a legislative agency, the |
|---|
| 35 | 35 | | secretary of state shall provide the requestor with electronic |
|---|
| 36 | 36 | | notification of rulemaking filings by a state agency [A state |
|---|
| 37 | 37 | | agency shall deliver to the lieutenant governor and the speaker of |
|---|
| 38 | 38 | | the house of representatives a copy of the notice of a proposed rule |
|---|
| 39 | 39 | | when the agency files notice with the secretary of state] under |
|---|
| 40 | 40 | | Section 2001.023. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2011. |
