| 7 | 7 | | relating to the duties of the secretary of state. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 405.017, Government Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 405.017. MISCELLANEOUS DUTIES. The secretary of state |
|---|
| 12 | 12 | | shall: |
|---|
| 13 | 13 | | (1) affix the state seal to all official documents |
|---|
| 14 | 14 | | issued from the secretary of state's office; |
|---|
| 15 | 15 | | (2) unless provided otherwise by law, commission state |
|---|
| 16 | 16 | | officers; |
|---|
| 17 | 17 | | (3) keep [in a separate suitable book] a register of |
|---|
| 18 | 18 | | all state officers; |
|---|
| 19 | 19 | | (4) immediately on receipt, deliver to the person in |
|---|
| 20 | 20 | | charge of the state library all books, maps, charts, printed |
|---|
| 21 | 21 | | volumes of the laws of a nation, territory, or another state, or |
|---|
| 22 | 22 | | other political or miscellaneous publications received in the |
|---|
| 23 | 23 | | secretary of state's office; |
|---|
| 24 | 24 | | (5) immediately on receipt, deliver to the supreme |
|---|
| 25 | 25 | | court librarian reports of courts of a nation, territory, or |
|---|
| 26 | 26 | | another state received in the secretary of state's office; and |
|---|
| 27 | 27 | | (6) perform such other and further duties as may be |
|---|
| 28 | 28 | | directed by the governor. |

| 29 | 29 | | SECTION 2. Subsections (b) and (c), Section 405.019, |
|---|
| 30 | 30 | | Government Code, are amended to read as follows: |
|---|
| 31 | 31 | | (b) The secretary of state shall make [send] the list |
|---|
| 32 | 32 | | available to [each of] the county clerks of this state before |
|---|
| 33 | 33 | | January 1 of each year. |
|---|
| 34 | 34 | | (c) The secretary of state shall amend the list and make |
|---|
| 35 | 35 | | [immediately send] the amended list available to the county clerks |
|---|
| 36 | 36 | | of this state if the secretary learns that a state or territory has |
|---|
| 37 | 37 | | changed its requirements relating to a notary public in a manner |
|---|
| 38 | 38 | | that requires it to be added to or deleted from the list. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2011. |
