| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | Code, is amended by adding Chapter 9303 to read as follows: |

| 12 | 12 | | CHAPTER 9303. EL PASO COUNTY WATER |
|---|
| 13 | 13 | | IMPROVEMENT DISTRICT NO. 1 |
|---|
| 14 | 14 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 15 | 15 | | Sec. 9303.001. DEFINITION. In this chapter, "district" |
|---|
| 16 | 16 | | means the El Paso County Water Improvement District No. 1. |
|---|
| 17 | 17 | | [Sections 9303.002-9303.050 reserved for expansion] |

| 18 | 18 | | SUBCHAPTER B. ADMINISTRATIVE PROVISIONS |
|---|
| 19 | 19 | | Sec. 9303.051. VOTER ELIGIBILITY. (a) An individual is |
|---|
| 20 | 20 | | eligible to vote in a district election only if the individual: |
|---|
| 21 | 21 | | (1) is 18 years of age or older; |
|---|
| 22 | 22 | | (2) is a United States citizen; |
|---|
| 23 | 23 | | (3) holds title to or an interest in title to irrigable |
|---|
| 24 | 24 | | land within the boundaries of the district; and |
|---|
| 25 | 25 | | (4) receives and uses irrigation water delivered by |
|---|
| 26 | 26 | | the district through the district's canal system. |
|---|
| 27 | 27 | | (b) To vote in a district election, an individual eligible |
|---|
| 28 | 28 | | to vote under Subsection (a) must register with the district not |
|---|
| 29 | 29 | | later than the 30th day before the date on which the district |
|---|
| 30 | 30 | | election is held. |
|---|
| 31 | 31 | | (c) The district shall file with the county clerk of El Paso |
|---|
| 32 | 32 | | County a certified copy of the list of the district's registered |
|---|
| 33 | 33 | | voters not later than the 25th day before the date on which a |
|---|
| 34 | 34 | | district election is held. |
|---|
| 35 | 35 | | Sec. 9303.052. DISTRICT PUBLICATION OF NOTICE CONCERNING |
|---|
| 36 | 36 | | VOTER ELIGIBILITY AND REGISTRATION. Not later than the 60th day and |
|---|
| 37 | 37 | | not earlier than the 90th day before the date of each district |
|---|
| 38 | 38 | | election, the district shall publish notice of the voter |
|---|
| 39 | 39 | | eligibility and registration requirements provided by Section |
|---|
| 40 | 40 | | 9303.051. |
|---|
| 41 | 41 | | SECTION 2. This Act takes effect September 1, 2011. |
