 A BILL TO BE ENTITLED
 AN ACT
 relating to notice provided to affected landowners of applications
 for transmission line certificates of convenience and necessity by
 electric utilities.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 37.054, Utilities Code, is amended by
 adding Subsection (a-1) to read as follows:
 (a-1)  In addition to the notice required under Subsection
 (a)(1), the commission by rule shall require the applicant to
 provide to each owner of land that would be affected notice by
 certified mail of an application to obtain or amend a certificate
 for the construction of a transmission line.
 SECTION 2.  The change in law made by this Act applies only
 to an application for a certificate of convenience and necessity
 filed on or after the effective date of this Act.  An application
 for a certificate filed before the effective date of this Act is
 governed by the law in effect on the date the application was filed,
 and that law is continued in effect for that purpose.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
