9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 30, Civil Practice and Remedies Code, is | |
11 | 11 | amended by adding Section 30.018 to read as follows: | |
12 | 12 | Sec. 30.018. COURT CLERK'S EXECUTION DOCKET. (a) The | |
13 | 13 | clerk of a court who is required to enter information into an | |
14 | 14 | execution docket under the Texas Rules of Civil Procedure or other | |
15 | 15 | law may enter and maintain the information in an electronic format | |
16 | 16 | that allows the information to be retrieved on the same basis as | |
17 | 17 | information would be retrieved manually using an index or | |
18 | 18 | cross-index to the docket that is otherwise required by law. | |
19 | 19 | (b) Notwithstanding Section 22.004, Government Code, the | |
20 | 20 | supreme court may not amend or adopt rules in conflict with this | |
21 | 21 | section. | |
22 | 22 | SECTION 2. Subsection (c), Section 34.03, Tax Code, is | |
23 | 23 | amended to read as follows: | |
24 | 24 | (c) The clerk shall note on the execution docket in each | |
25 | 25 | case the amount of the excess proceeds, the date they were received, | |
26 | 26 | and the date they were transmitted to the taxing units | |
27 | 27 | participating in the sale. Any local government record data may be | |
28 | 28 | stored electronically in addition to or instead of source documents | |
29 | 29 | in paper or other media. | |
30 | 30 | SECTION 3. This Act takes effect September 1, 2011. |
