8	8	AN ACT
9	9	relating to authorizing a lower-division institution of higher
10	10	education to award an associate degree to a student enrolled in a
11	11	four-year public institution of higher education who previously
12	12	attended the lower-division institution.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Subchapter S, Chapter 61, Education Code, is
15	15	amended by adding Section 61.833 to read as follows:
16	16	Sec. 61.833. CREDIT TRANSFER FOR ASSOCIATE DEGREE. (a) In
17	17	this section, "lower-division institution of higher education"
18	18	means a public junior college, public state college, or public
19	19	technical institute.
20	20	(b) This section applies to a student enrolled in a general
21	21	academic teaching institution who:
22	22	(1) transferred to the institution from or previously
23	23	attended a lower-division institution of higher education;
24	24	(2) earned at least 30 credit hours for course work
25	25	successfully completed at the lower-division institution of higher
26	26	education; and
27	27	(3) has earned a cumulative total of at least 90 credit
28	28	hours for course work successfully completed.
29	29	(c) As soon as practicable after a student who is enrolled
30	30	in a general academic teaching institution has met the criteria
31	31	established by Subsection (b)(3), the institution by e-mail or
32	32	other reasonable method shall request authorization from the
33	33	student for the institution to release the student's transcript to
34	34	the lower-division institution of higher education that the student
35	35	previously attended for the purpose of determining whether the
36	36	student has earned the credits required for an associate degree
37	37	awarded by the lower-division institution of higher education. On
38	38	receipt of a student's authorization under this subsection, the
39	39	general academic teaching institution shall release the student's
40	40	transcript to the lower-division institution of higher education.
41	41	(d) After receiving a student transcript from a general
42	42	academic teaching institution under Subsection (c), a
43	43	lower-division institution of higher education shall review the
44	44	transcript and, if the lower-division institution of higher
45	45	education determines the student has earned the credits required to
46	46	receive an associate degree awarded by the lower-division
47	47	institution of higher education, may award the student the degree.
48	48	SECTION 2. The change in law made by this Act applies to a
49	49	student who not earlier than the 2011 fall semester transfers to or
50	50	otherwise initially enrolls in a general academic teaching
51	51	institution after attending a lower-division institution of higher
52	52	education.
53	53	SECTION 3. This Act takes effect immediately if it receives
54	54	a vote of two-thirds of all the members elected to each house, as
55	55	provided by Section 39, Article III, Texas Constitution. If this
56	56	Act does not receive the vote necessary for immediate effect, this
57	57	Act takes effect September 1, 2011.
