| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subsection (a), Section 554.001, Health and | |
| 11 | 11 | Safety Code, is amended to read as follows: | |
| 12 | 12 | (a) The department shall use the Waco Center for Youth as a | |
| 13 | 13 | residential treatment facility for emotionally disturbed juveniles | |
| 14 | 14 | who: | |
| 15 | 15 | (1) have been admitted [committed] under Subtitle C to | |
| 16 | 16 | a facility of the department; or | |
| 17 | 17 | (2) are under the managing conservatorship of the | |
| 18 | 18 | Department of Family and Protective [and Regulatory] Services and | |
| 19 | 19 | have been admitted [committed] under Subtitle C to the Waco Center | |
| 20 | 20 | for Youth. | |
| 21 | 21 | SECTION 2. The change in law made by this Act to Subsection | |
| 22 | 22 | (a), Section 554.001, Health and Safety Code, is a clarification of | |
| 23 | 23 | existing law and does not imply that the former law may be construed | |
| 24 | 24 | as inconsistent with the law as amended by this Act. | |
| 25 | 25 | SECTION 3. This Act takes effect immediately if it receives | |
| 26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
| 27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
| 28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
| 29 | 29 | Act takes effect September 1, 2011. |
