| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (a), Section 28.0251, Education Code, |
|---|
| 11 | 11 | | is amended to read as follows: |
|---|
| 12 | 12 | | (a) Notwithstanding any other provision of this code, a |
|---|
| 13 | 13 | | school district may issue a high school diploma to a person who: |
|---|
| 14 | 14 | | (1) is an honorably discharged member of the armed |
|---|
| 15 | 15 | | forces of the United States; |
|---|
| 16 | 16 | | (2) was scheduled to graduate from high school: |
|---|
| 17 | 17 | | (A) after 1940 and before 1975; or |
|---|
| 18 | 18 | | (B) after 1989; and |
|---|
| 19 | 19 | | (3) left [high] school after completing the sixth or a |
|---|
| 20 | 20 | | higher grade, before graduating from high school, [graduation] to |
|---|
| 21 | 21 | | serve in: |
|---|
| 22 | 22 | | (A) World War II, the Korean War, [or] the |
|---|
| 23 | 23 | | Vietnam War, the Persian Gulf War, the Iraq War, or the war in |
|---|
| 24 | 24 | | Afghanistan; or |
|---|
| 25 | 25 | | (B) any other war formally declared by the United |
|---|
| 26 | 26 | | States, military engagement authorized by the United States |
|---|
| 27 | 27 | | Congress, military engagement authorized by a United Nations |
|---|
| 28 | 28 | | Security Council resolution and funded by the United States |
|---|
| 29 | 29 | | Congress, or conflict authorized by the president of the United |
|---|
| 30 | 30 | | States under the War Powers Resolution of 1973 (50 U.S.C. Section |
|---|
| 31 | 31 | | 1541 et seq.). |

| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2011. |
