55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the term of office and qualifications for a director of
88 the Colorado County Groundwater Conservation District.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (c), Section 8824.051, Special
1111 District Local Laws Code, is amended to read as follows:
1212 (c) A director may serve only two full consecutive terms in
1313 the same position.
1414 SECTION 2. Subsection (a), Section 8824.052, Special
1515 District Local Laws Code, is amended to read as follows:
1616 (a) Except as provided by Subsection (e), the directors of
1717 the district shall be elected as follows:
1818 (1) the directors for positions 1 through 4 must
1919 reside in Colorado County Commissioners Precincts 1 through 4,
2020 respectively, and are elected by the voters of the applicable
2121 county commissioners precinct; and
2222 (2) the directors for positions 5 through 7 must
2323 reside in Colorado County [the cities of Columbus, Eagle Lake, and
2424 Weimar, respectively,] and are elected at large by the voters of the
2525 district.
2626 SECTION 3. The change in law made by this Act does not
2727 affect the term of a member of the board of directors of the
2828 Colorado County Groundwater Conservation District serving on the
2929 effective date of this Act. A director appointed to fill a vacancy
3030 occurring on or after the effective date of this Act must be
3131 appointed in accordance with Subsection (c), Section 8824.051, and
3232 Subsection (a), Section 8824.052, Special District Local Laws Code,
3333 as amended by this Act.
3434 SECTION 4. (a) The legal notice of the intention to
3535 introduce this Act, setting forth the general substance of this
3636 Act, has been published as provided by law, and the notice and a
3737 copy of this Act have been furnished to all persons, agencies,
3838 officials, or entities to which they are required to be furnished
3939 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4040 Government Code.
4141 (b) The governor, one of the required recipients, has
4242 submitted the notice and Act to the Texas Commission on
4343 Environmental Quality.
4444 (c) The Texas Commission on Environmental Quality has filed
4545 its recommendations relating to this Act with the governor, the
4646 lieutenant governor, and the speaker of the house of
4747 representatives within the required time.
4848 (d) All requirements of the constitution and laws of this
4949 state and the rules and procedures of the legislature with respect
5050 to the notice, introduction, and passage of this Act are fulfilled
5151 and accomplished.
5252 SECTION 5. This Act takes effect immediately if it receives
5353 a vote of two-thirds of all the members elected to each house, as
5454 provided by Section 39, Article III, Texas Constitution. If this
5555 Act does not receive the vote necessary for immediate effect, this
5656 Act takes effect September 1, 2011.
