7 | 7 | | relating to the term of office and qualifications for a director of |

8 | 8 | | the Colorado County Groundwater Conservation District. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subsection (c), Section 8824.051, Special |
---|
11 | 11 | | District Local Laws Code, is amended to read as follows: |
---|
12 | 12 | | (c) A director may serve only two full consecutive terms in |
---|
13 | 13 | | the same position. |
---|
14 | 14 | | SECTION 2. Subsection (a), Section 8824.052, Special |
---|
15 | 15 | | District Local Laws Code, is amended to read as follows: |
---|
16 | 16 | | (a) Except as provided by Subsection (e), the directors of |
---|
17 | 17 | | the district shall be elected as follows: |
---|
18 | 18 | | (1) the directors for positions 1 through 4 must |
---|
19 | 19 | | reside in Colorado County Commissioners Precincts 1 through 4, |
---|
20 | 20 | | respectively, and are elected by the voters of the applicable |
---|
21 | 21 | | county commissioners precinct; and |
---|
22 | 22 | | (2) the directors for positions 5 through 7 must |
---|
23 | 23 | | reside in Colorado County [the cities of Columbus, Eagle Lake, and |
---|
24 | 24 | | Weimar, respectively,] and are elected at large by the voters of the |
---|
25 | 25 | | district. |
---|
26 | 26 | | SECTION 3. The change in law made by this Act does not |
---|
27 | 27 | | affect the term of a member of the board of directors of the |
---|
28 | 28 | | Colorado County Groundwater Conservation District serving on the |
---|
29 | 29 | | effective date of this Act. A director appointed to fill a vacancy |
---|
30 | 30 | | occurring on or after the effective date of this Act must be |
---|
31 | 31 | | appointed in accordance with Subsection (c), Section 8824.051, and |
---|
32 | 32 | | Subsection (a), Section 8824.052, Special District Local Laws Code, |
---|
33 | 33 | | as amended by this Act. |
---|
34 | 34 | | SECTION 4. (a) The legal notice of the intention to |
---|
35 | 35 | | introduce this Act, setting forth the general substance of this |
---|
36 | 36 | | Act, has been published as provided by law, and the notice and a |
---|
37 | 37 | | copy of this Act have been furnished to all persons, agencies, |
---|
38 | 38 | | officials, or entities to which they are required to be furnished |
---|
39 | 39 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
---|
40 | 40 | | Government Code. |
---|
41 | 41 | | (b) The governor, one of the required recipients, has |
---|
42 | 42 | | submitted the notice and Act to the Texas Commission on |
---|
43 | 43 | | Environmental Quality. |
---|
44 | 44 | | (c) The Texas Commission on Environmental Quality has filed |
---|
45 | 45 | | its recommendations relating to this Act with the governor, the |
---|
46 | 46 | | lieutenant governor, and the speaker of the house of |
---|
47 | 47 | | representatives within the required time. |
---|
48 | 48 | | (d) All requirements of the constitution and laws of this |
---|
49 | 49 | | state and the rules and procedures of the legislature with respect |
---|
50 | 50 | | to the notice, introduction, and passage of this Act are fulfilled |
---|
51 | 51 | | and accomplished. |
---|
52 | 52 | | SECTION 5. This Act takes effect immediately if it receives |
---|
53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
---|
54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
---|
56 | 56 | | Act takes effect September 1, 2011. |
