99 relating to the creation of a cybersecurity, education, and
1010 economic development council.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 2054, Government Code, is amended by
1313 adding Subchapter N to read as follows:
1414 SUBCHAPTER N. CYBERSECURITY, EDUCATION,
1515 AND ECONOMIC DEVELOPMENT COUNCIL
1616 Sec. 2054.501. DEFINITION. In this subchapter, "council"
1717 means the Cybersecurity, Education, and Economic Development
1818 Council.
1919 Sec. 2054.502. CYBERSECURITY, EDUCATION, AND ECONOMIC
2020 DEVELOPMENT COUNCIL; COMPOSITION. (a) The Cybersecurity,
2121 Education, and Economic Development Council is established.
2222 (b) The council is composed of nine members appointed by the
2323 executive director. The members must include:
2424 (1) one representative from the department;
2525 (2) one representative from the Texas Economic
2626 Development and Tourism Office in the office of the governor;
2727 (3) two representatives from institutions of higher
2828 education with cybersecurity-related programs;
2929 (4) one representative from a public junior college,
3030 as defined by Section 61.003, Education Code, with a
3131 cybersecurity-related program;
3232 (5) one state military forces liaison experienced in
3333 the cybersecurity field; and
3434 (6) three representatives from chamber of commerce
3535 organizations or businesses who have a cybersecurity background.
3636 (c) The council shall elect a presiding officer from among
3737 its members.
3838 (d) A council member serves at the pleasure of the executive
3939 director.
4040 Sec. 2054.503. COMPENSATION. A council member serves
4141 without compensation or reimbursement of expenses.
4242 Sec. 2054.504. COUNCIL POWERS AND DUTIES. (a) The council
4343 shall:
4444 (1) at least quarterly, meet at the call of the
4545 presiding officer; and
4646 (2) conduct an interim study and make recommendations
4747 to the executive director regarding:
4848 (A) improving the infrastructure of this state's
4949 cybersecurity operations with existing resources and through
5050 partnerships between government, business, and institutions of
5151 higher education; and
5252 (B) examining specific actions to accelerate the
5353 growth of cybersecurity as an industry in this state.
5454 (b) The council may request the assistance of state
5555 agencies, departments, or offices to carry out its duties.
5656 Sec. 2054.505. REPORT. Not later than December 1, 2012, the
5757 council shall submit a report based on its findings to:
5858 (1) the executive director;
5959 (2) the governor;
6060 (3) the lieutenant governor;
6161 (4) the speaker of the house of representatives;
6262 (5) the higher education committees of the senate and
6363 house of representatives;
6464 (6) the Senate Committee on Economic Development;
6565 (7) the House Technology Committee; and
6666 (8) the House Economic and Small Business Development
6767 Committee.
6868 Sec. 2054.506. EXPIRATION OF SUBCHAPTER. This subchapter
6969 expires and the council is abolished September 1, 2013.
7070 SECTION 2. Not later than the 30th day after the effective
7171 date of this Act, the executive director of the Department of
7272 Information Resources shall appoint the members of the
7373 Cybersecurity, Education, and Economic Development Council as
7474 established by Subchapter N, Chapter 2054, Government Code, as
7575 added by this Act.
7676 SECTION 3. This Act takes effect September 1, 2011.
