| 7 | 7 | | relating to notice required for termination of a teacher's |

| 8 | 8 | | probationary contract or nonrenewal of a teacher's term contract. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 21.103(a), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (a) The board of trustees of a school district may terminate |
|---|
| 13 | 13 | | the employment of a teacher employed under a probationary contract |
|---|
| 14 | 14 | | at the end of the contract period if in the board's judgment the |
|---|
| 15 | 15 | | best interests of the district will be served by terminating the |
|---|
| 16 | 16 | | employment. The board of trustees must give notice of its decision |
|---|
| 17 | 17 | | to terminate the employment to the teacher not later than the 15th |
|---|
| 18 | 18 | | [45th] day before the last day of instruction required under the |
|---|
| 19 | 19 | | contract. The notice must be delivered personally to the teacher or |
|---|
| 20 | 20 | | mailed by prepaid certified mail to the teacher's address of record |
|---|
| 21 | 21 | | with the district. Notice that is mailed in accordance with this |
|---|
| 22 | 22 | | subsection is considered given at the time of mailing. The board's |
|---|
| 23 | 23 | | decision is final and may not be appealed. |

| 24 | 24 | | SECTION 2. Section 21.206(a), Education Code, is amended to |
|---|
| 25 | 25 | | read as follows: |
|---|
| 26 | 26 | | (a) Not later than the 15th [45th] day before the last day of |
|---|
| 27 | 27 | | instruction in a school year, the board of trustees shall notify in |
|---|
| 28 | 28 | | writing each teacher whose contract is about to expire whether the |
|---|
| 29 | 29 | | board proposes to renew or not renew the contract. The notice must |
|---|
| 30 | 30 | | be delivered personally to the teacher or mailed by prepaid |
|---|
| 31 | 31 | | certified mail to the teacher's address of record with the |
|---|
| 32 | 32 | | district. Notice that is mailed in accordance with this subsection |
|---|
| 33 | 33 | | is considered given at the time of mailing. |
|---|
| 34 | 34 | | SECTION 3. The change in law made by Sections 21.103 and |
|---|
| 35 | 35 | | 21.206, Education Code, as amended by this Act, applies beginning |
|---|
| 36 | 36 | | with contracts for the 2012-2013 school year. |
|---|
| 37 | 37 | | SECTION 4. This Act takes effect on the 91st day after the |
|---|
| 38 | 38 | | last day of the legislative session. |
