77 relating to notice required for termination of a teacher's
88 probationary contract or nonrenewal of a teacher's term contract.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.103(a), Education Code, is amended to
1111 read as follows:
1212 (a) The board of trustees of a school district may terminate
1313 the employment of a teacher employed under a probationary contract
1414 at the end of the contract period if in the board's judgment the
1515 best interests of the district will be served by terminating the
1616 employment. The board of trustees must give notice of its decision
1717 to terminate the employment to the teacher not later than the 15th
1818 [45th] day before the last day of instruction required under the
1919 contract. The notice must be delivered personally to the teacher or
2020 mailed by prepaid certified mail to the teacher's address of record
2121 with the district. Notice that is mailed in accordance with this
2222 subsection is considered given at the time of mailing. The board's
2323 decision is final and may not be appealed.
2424 SECTION 2. Section 21.206(a), Education Code, is amended to
2525 read as follows:
2626 (a) Not later than the 15th [45th] day before the last day of
2727 instruction in a school year, the board of trustees shall notify in
2828 writing each teacher whose contract is about to expire whether the
2929 board proposes to renew or not renew the contract. The notice must
3030 be delivered personally to the teacher or mailed by prepaid
3131 certified mail to the teacher's address of record with the
3232 district. Notice that is mailed in accordance with this subsection
3333 is considered given at the time of mailing.
3434 SECTION 3. The change in law made by Sections 21.103 and
3535 21.206, Education Code, as amended by this Act, applies beginning
3636 with contracts for the 2012-2013 school year.
3737 SECTION 4. This Act takes effect on the 91st day after the
3838 last day of the legislative session.
