| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 33.021, Penal Code, is amended by |
|---|
| 13 | 13 | | amending Subsection (f) and adding Subsection (f-1) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (f) An offense under Subsection (b) is a felony of the third |
|---|
| 16 | 16 | | degree, except that the offense is a felony of the second degree if |
|---|
| 17 | 17 | | the minor is younger than 14 years of age or is an individual whom |
|---|
| 18 | 18 | | the actor believes to be younger than 14 years of age at the time of |
|---|
| 19 | 19 | | the commission of the offense. |
|---|
| 20 | 20 | | (f-1) An offense under Subsection (c) is a felony of the |
|---|
| 21 | 21 | | second degree, except that the minimum term of imprisonment for the |
|---|
| 22 | 22 | | offense is increased to five years if the actor, after soliciting |
|---|
| 23 | 23 | | the minor on the actor's own behalf, travels with the intent to meet |
|---|
| 24 | 24 | | the minor. |
|---|
| 25 | 25 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 26 | 26 | | to an offense committed on or after the effective date of this Act. |
|---|
| 27 | 27 | | An offense committed before the effective date of this Act is |
|---|
| 28 | 28 | | governed by the law in effect on the date the offense was committed, |
|---|
| 29 | 29 | | and the former law is continued in effect for that purpose. For |
|---|
| 30 | 30 | | purposes of this section, an offense was committed before the |
|---|
| 31 | 31 | | effective date of this Act if any element of the offense occurred |
|---|
| 32 | 32 | | before that date. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2013. |
