88 AN ACT
99 relating to the punishment for the offense of online solicitation
1010 of a minor.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 33.021, Penal Code, is amended by
1313 amending Subsection (f) and adding Subsection (f-1) to read as
1414 follows:
1515 (f) An offense under Subsection (b) is a felony of the third
1616 degree, except that the offense is a felony of the second degree if
1717 the minor is younger than 14 years of age or is an individual whom
1818 the actor believes to be younger than 14 years of age at the time of
1919 the commission of the offense.
2020 (f-1) An offense under Subsection (c) is a felony of the
2121 second degree, except that the minimum term of imprisonment for the
2222 offense is increased to five years if the actor, after soliciting
2323 the minor on the actor's own behalf, travels with the intent to meet
2424 the minor.
2525 SECTION 2. The change in law made by this Act applies only
2626 to an offense committed on or after the effective date of this Act.
2727 An offense committed before the effective date of this Act is
2828 governed by the law in effect on the date the offense was committed,
2929 and the former law is continued in effect for that purpose. For
3030 purposes of this section, an offense was committed before the
3131 effective date of this Act if any element of the offense occurred
3232 before that date.
3333 SECTION 3. This Act takes effect September 1, 2013.
