77 relating to venue for the offense of failure to attend school.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 25.094(b), Education Code, is amended to
1010 read as follows:
1111 (b) An offense under this section may be prosecuted in:
1212 (1) the constitutional county court of the county in
1313 which the individual resides or in which the school is located, if
1414 the county has a population of 1.75 million or more;
1515 (2) a justice court designated to hear cases arising
1616 under this section [of any precinct] in the county in which the
1717 individual resides or in which the school is located, or if no
1818 justice court is designated, a justice court of any precinct in the
1919 county in which the individual resides or in which the school is
2020 located; or
2121 (3) a municipal court in the municipality in which the
2222 individual resides or in which the school is located.
2323 SECTION 2. The changes in law made by this Act to Section
2424 25.094, Education Code, apply only to an offense committed on or
2525 after the effective date of this Act. For purposes of this section,
2626 an offense is committed before the effective date of this Act if any
2727 element of the offense occurs before that date. An offense
2828 committed before the effective date of this Act is covered by the
2929 law in effect immediately before the effective date of this Act, and
3030 the former law is continued in effect for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2013.
