99 AN ACT
1010 relating to the offense of the unauthorized duplication of certain
1111 recordings.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 641.051, Business & Commerce Code, is
1414 amended by adding Subsection (e) to read as follows:
1515 (e) This section does not apply to a person engaged in radio
1616 or television broadcasting who transfers, or causes to be
1717 transferred, a recording:
1818 (1) intended for or in connection with a radio or
1919 television broadcast; or
2020 (2) for archival purposes.
2121 SECTION 2. The change in law made by this Act to Section
2222 641.051, Business & Commerce Code, does not apply to an offense
2323 committed under that section before the effective date of this Act.
2424 An offense committed before the effective date of this Act is
2525 governed by that section as it existed on the date the offense was
2626 committed, and the former law is continued in effect for that
2727 purpose. For purposes of this section, an offense was committed
2828 before the effective date of this Act if any element of the offense
2929 occurred before that date.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2013.
