| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 641.051, Business & Commerce Code, is |
|---|
| 14 | 14 | | amended by adding Subsection (e) to read as follows: |
|---|
| 15 | 15 | | (e) This section does not apply to a person engaged in radio |
|---|
| 16 | 16 | | or television broadcasting who transfers, or causes to be |
|---|
| 17 | 17 | | transferred, a recording: |
|---|
| 18 | 18 | | (1) intended for or in connection with a radio or |
|---|
| 19 | 19 | | television broadcast; or |
|---|
| 20 | 20 | | (2) for archival purposes. |

| 21 | 21 | | SECTION 2. The change in law made by this Act to Section |
|---|
| 22 | 22 | | 641.051, Business & Commerce Code, does not apply to an offense |
|---|
| 23 | 23 | | committed under that section before the effective date of this Act. |
|---|
| 24 | 24 | | An offense committed before the effective date of this Act is |
|---|
| 25 | 25 | | governed by that section as it existed on the date the offense was |
|---|
| 26 | 26 | | committed, and the former law is continued in effect for that |
|---|
| 27 | 27 | | purpose. For purposes of this section, an offense was committed |
|---|
| 28 | 28 | | before the effective date of this Act if any element of the offense |
|---|
| 29 | 29 | | occurred before that date. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2013. |
