12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 28.004(e), Education Code, is amended to |
---|
14 | 14 | | read as follows: |
---|
15 | 15 | | (e) Any course materials and instruction relating to human |
---|
16 | 16 | | sexuality, sexually transmitted diseases, or human |
---|
17 | 17 | | immunodeficiency virus or acquired immune deficiency syndrome |
---|
18 | 18 | | shall be selected by the board of trustees with the advice of the |
---|
19 | 19 | | local school health advisory council and [must]: |
---|
20 | 20 | | (1) must present abstinence from sexual activity as |
---|
21 | 21 | | the preferred choice of behavior in relationship to all sexual |
---|
22 | 22 | | activity for unmarried persons of school age; |
---|
23 | 23 | | (2) must devote more attention to abstinence from |
---|
24 | 24 | | sexual activity than to any other behavior; |
---|
25 | 25 | | (3) must emphasize that abstinence from sexual |
---|
26 | 26 | | activity, if used consistently and correctly, is the only method |
---|
27 | 27 | | that is 100 percent effective in preventing pregnancy, sexually |
---|
28 | 28 | | transmitted diseases, infection with human immunodeficiency virus |
---|
29 | 29 | | or acquired immune deficiency syndrome, and the emotional trauma |
---|
30 | 30 | | associated with adolescent sexual activity; |
---|
31 | 31 | | (4) must direct adolescents to a standard of behavior |
---|
32 | 32 | | in which abstinence from sexual activity before marriage is the |
---|
33 | 33 | | most effective way to prevent pregnancy, sexually transmitted |
---|
34 | 34 | | diseases, and infection with human immunodeficiency virus or |
---|
35 | 35 | | acquired immune deficiency syndrome; [and] |
---|
36 | 36 | | (5) must teach contraception and condom use in terms |
---|
37 | 37 | | of human use reality rates instead of theoretical laboratory rates, |
---|
38 | 38 | | if instruction on contraception and condoms is included in |
---|
39 | 39 | | curriculum content; and |
---|
40 | 40 | | (6) may not teach or present information relating to |
---|
41 | 41 | | abortion, including referrals for abortion. |
---|
42 | 42 | | SECTION 2. This Act applies beginning with the 2013-2014 |
---|
43 | 43 | | school year. |
---|
44 | 44 | | SECTION 3. This Act takes effect immediately if it receives |
---|
45 | 45 | | a vote of two-thirds of all the members elected to each house, as |
---|
46 | 46 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
47 | 47 | | Act does not receive the vote necessary for immediate effect, this |
---|
48 | 48 | | Act takes effect September 1, 2013. |
