99 AN ACT
1010 relating to providing human sexuality instruction in public
1111 schools.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 28.004(e), Education Code, is amended to
1414 read as follows:
1515 (e) Any course materials and instruction relating to human
1616 sexuality, sexually transmitted diseases, or human
1717 immunodeficiency virus or acquired immune deficiency syndrome
1818 shall be selected by the board of trustees with the advice of the
1919 local school health advisory council and [must]:
2020 (1) must present abstinence from sexual activity as
2121 the preferred choice of behavior in relationship to all sexual
2222 activity for unmarried persons of school age;
2323 (2) must devote more attention to abstinence from
2424 sexual activity than to any other behavior;
2525 (3) must emphasize that abstinence from sexual
2626 activity, if used consistently and correctly, is the only method
2727 that is 100 percent effective in preventing pregnancy, sexually
2828 transmitted diseases, infection with human immunodeficiency virus
2929 or acquired immune deficiency syndrome, and the emotional trauma
3030 associated with adolescent sexual activity;
3131 (4) must direct adolescents to a standard of behavior
3232 in which abstinence from sexual activity before marriage is the
3333 most effective way to prevent pregnancy, sexually transmitted
3434 diseases, and infection with human immunodeficiency virus or
3535 acquired immune deficiency syndrome; [and]
3636 (5) must teach contraception and condom use in terms
3737 of human use reality rates instead of theoretical laboratory rates,
3838 if instruction on contraception and condoms is included in
3939 curriculum content; and
4040 (6) may not teach or present information relating to
4141 abortion, including referrals for abortion.
4242 SECTION 2. This Act applies beginning with the 2013-2014
4343 school year.
4444 SECTION 3. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2013.
