66 AN ACT
77 relating to the classification of certain misdemeanor and felony
88 theft offenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 31.03(e), Penal Code, is amended to read
1111 as follows:
1212 (e) Except as provided by Subsection (f), an offense under
1313 this section is:
1414 (1) a Class C misdemeanor if the value of the property
1515 stolen is less than:
1616 (A) $100 [$50]; or
1717 (B) $20 and the defendant obtained the property
1818 by issuing or passing a check or similar sight order in a manner
1919 described by Section 31.06;
2020 (2) a Class B misdemeanor if:
2121 (A) the value of the property stolen is:
2222 (i) $100 [$50] or more but less than $1,000
2323 [$500]; or
2424 (ii) $20 or more but less than $1,000 [$500]
2525 and the defendant obtained the property by issuing or passing a
2626 check or similar sight order in a manner described by Section 31.06;
2727 (B) the value of the property stolen is less
2828 than:
2929 (i) $100 [$50] and the defendant has
3030 previously been convicted of any grade of theft; or
3131 (ii) $20, the defendant has previously been
3232 convicted of any grade of theft, and the defendant obtained the
3333 property by issuing or passing a check or similar sight order in a
3434 manner described by Section 31.06; or
3535 (C) the property stolen is a driver's license,
3636 commercial driver's license, or personal identification
3737 certificate issued by this state or another state;
3838 (3) a Class A misdemeanor if the value of the property
3939 stolen is $1,000 [$500] or more but less than $3,000 [$1,500];
4040 (4) a state jail felony if:
4141 (A) the value of the property stolen is $3,000
4242 [$1,500] or more but less than $20,000, or the property is less than
4343 10 head of sheep, swine, or goats or any part thereof under the
4444 value of $20,000;
4545 (B) regardless of value, the property is stolen
4646 from the person of another or from a human corpse or grave,
4747 including property that is a military grave marker;
4848 (C) the property stolen is a firearm, as defined
4949 by Section 46.01;
5050 (D) the value of the property stolen is less than
5151 $3,000 [$1,500] and the defendant has been previously convicted two
5252 or more times of any grade of theft;
5353 (E) the property stolen is an official ballot or
5454 official carrier envelope for an election; or
5555 (F) the value of the property stolen is less than
5656 $20,000 and the property stolen is:
5757 (i) aluminum;
5858 (ii) bronze;
5959 (iii) copper; or
6060 (iv) brass;
6161 (5) a felony of the third degree if the value of the
6262 property stolen is $20,000 or more but less than $100,000, or the
6363 property is:
6464 (A) cattle, horses, or exotic livestock or exotic
6565 fowl as defined by Section 142.001, Agriculture Code, stolen during
6666 a single transaction and having an aggregate value of less than
6767 $100,000; or
6868 (B) 10 or more head of sheep, swine, or goats
6969 stolen during a single transaction and having an aggregate value of
7070 less than $100,000;
7171 (6) a felony of the second degree if:
7272 (A) the value of the property stolen is $100,000
7373 or more but less than $200,000; or
7474 (B) the value of the property stolen is less than
7575 $200,000 and the property stolen is an automated teller machine or
7676 the contents or components of an automated teller machine; or
7777 (7) a felony of the first degree if the value of the
7878 property stolen is $200,000 or more.
7979 SECTION 2. Section 31.08(c), Penal Code, is amended to read
8080 as follows:
8181 (c) If property or service has value that cannot be
8282 reasonably ascertained by the criteria set forth in Subsections (a)
8383 and (b), the property or service is deemed to have a value of, as
8484 applicable:
8585 (1) $500 or more but less than $1,500; or
8686 (2) $1,000 or more but less than $3,000, if the actor
8787 is charged with an offense under Section 31.03.
8888 SECTION 3. The change in law made by this Act applies only
8989 to an offense committed on or after the effective date of this Act.
9090 An offense committed before the effective date of this Act is
9191 governed by the law in effect on the date the offense was committed,
9292 and the former law is continued in effect for that purpose. For
9393 purposes of this section, an offense was committed before the
9494 effective date of this Act if any element of the offense occurred
9595 before that date.
9696 SECTION 4. This Act takes effect September 1, 2013.
