77 relating to the eligibility of certain persons for the supplemental
88 nutrition assistance program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 33, Human Resources Code,
1111 is amended by adding Section 33.018 to read as follows:
1212 Sec. 33.018. EFFECT OF NONCOMPLIANCE WITH WORK REQUIREMENTS
1313 ON SNAP ELIGIBILITY. If an individual who is the head of household
1414 becomes ineligible for supplemental nutrition assistance benefits
1515 for failing to comply with the employment or employment and
1616 training program requirements in 7 U.S.C. Section 2015(d)(1)(A),
1717 the department may not deny those benefits to the other eligible
1818 household members for that reason.
1919 SECTION 2. The change in law made by this Act applies only
2020 to a determination of eligibility of a person for supplemental
2121 nutrition assistance benefits made on or after the effective date
2222 of this Act. A determination of eligibility made before the
2323 effective date of this Act is governed by the law in effect on the
2424 date the determination was made, and the former law is continued in
2525 effect for that purpose.
2626 SECTION 3. If before implementing any provision of this Act
2727 a state agency determines that a waiver or authorization from a
2828 federal agency is necessary for implementation of that provision,
2929 the agency affected by the provision shall request the waiver or
3030 authorization and may delay implementing that provision until the
3131 waiver or authorization is granted.
3232 SECTION 4. This Act takes effect September 1, 2013.
