77 relating to family cost share provisions in the early childhood
88 intervention program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 117, Human Resources Code,
1111 is amended by adding Sections 117.077 and 117.078 to read as
1212 follows:
1313 Sec. 117.077. DATA ANALYSIS IN FAMILY COST SHARE PROVISIONS
1414 IN EARLY CHILDHOOD INTERVENTION PROGRAM. (a) In this section,
1515 "cost-effective" means the family cost share revenue generated is
1616 greater than total administrative costs.
1717 (b) The department shall collect data, including data on
1818 administrative costs and adjusted family income, sufficient to
1919 evaluate:
2020 (1) the cost-effectiveness of the family cost share
2121 provisions of the early childhood intervention program; and
2222 (2) changes necessary to improve the
2323 cost-effectiveness of the program.
2424 (c) The department shall:
2525 (1) as necessary, modify the Texas Kids Intervention
2626 Data System to accept adjusted family income data submitted by
2727 early childhood intervention program providers; and
2828 (2) require all providers to enter adjusted family
2929 income data into the system.
3030 (d) The department shall use the data collected under this
3131 section to evaluate the cost-effectiveness of existing family cost
3232 share provisions in the early childhood intervention program and
3333 consider changes that may improve the cost-effectiveness of the
3434 program, including the adoption of a family cost share provision
3535 described by Section 117.078(a).
3636 (e) The department shall implement any changes considered
3737 under Subsection (d) that the department determines will make the
3838 early childhood intervention program more cost-effective. If none
3939 of the considered changes is determined to make the program more
4040 cost-effective, the department may decline to implement the
4141 changes.
4242 (f) The department shall evaluate existing family cost
4343 share provisions and consider and implement changes, if
4444 appropriate, to the early childhood intervention program as
4545 required by this section:
4646 (1) on a periodic basis established by the department;
4747 and
4848 (2) at other times at the request of the Legislative
4949 Budget Board.
5050 (g) Not later than December 1, 2014, the department shall:
5151 (1) conduct the initial evaluation required under
5252 Subsection (d) and implement any changes as required by Subsection
5353 (e) resulting from that evaluation; and
5454 (2) submit a report to the governor and the
5555 Legislative Budget Board summarizing the results of the initial
5656 evaluation and explaining any changes that were implemented.
5757 (h) This subsection and Subsection (g) expire September 1,
5858 2015.
5959 Sec. 117.078. FAMILY COST SHARE PROVISION IN EARLY
6060 CHILDHOOD INTERVENTION PROGRAM. (a) The department shall consider
6161 implementing a family cost share provision under which the amount a
6262 family pays to participate in the early childhood intervention
6363 program is based on the amount of service the family receives under
6464 the program.
6565 (b) A family cost share provision implemented by the
6666 department under Subsection (a) must establish a maximum amount to
6767 be paid by a family participating in the early childhood
6868 intervention program that is based on the family's size and
6969 adjusted gross income, with families in higher income brackets
7070 required to pay more under the provision than those families paid
7171 before the provision's implementation.
7272 SECTION 2. If before implementing any provision of this Act
7373 a state agency determines that a waiver or authorization from a
7474 federal agency is necessary for implementation of that provision,
7575 the agency affected by the provision shall request the waiver or
7676 authorization and may delay implementing that provision until the
7777 waiver or authorization is granted.
7878 SECTION 3. This Act takes effect September 1, 2013.
