55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the collection of information regarding trafficking of
88 persons.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 402.035, Government Code, is amended by
1111 adding Subsection (b-1) and amending Subsection (d) to read as
1212 follows:
1313 (b-1) A state or local law enforcement agency, district
1414 attorney, or county attorney that assists in the prevention of
1515 human trafficking shall, at the request of the task force,
1616 cooperate and assist the task force in collecting any statistical
1717 data on the nature and extent of human trafficking in the possession
1818 of the law enforcement agency or district or county attorney.
1919 (d) The task force shall:
2020 (1) collaborate, as needed to fulfill the duties of
2121 the task force, with:
2222 (A) United States attorneys for the districts of
2323 Texas; and
2424 (B) special agents or customs and border
2525 protection officers and border patrol agents of:
2626 (i) the Federal Bureau of Investigation;
2727 (ii) the United States Drug Enforcement
2828 Administration;
2929 (iii) the Bureau of Alcohol, Tobacco,
3030 Firearms and Explosives;
3131 (iv) [the] United States Immigration and
3232 Customs Enforcement [Agency]; or
3333 (v) the United States Department of
3434 Homeland Security;
3535 (2) collect, organize, and periodically publish
3636 statistical data on the nature and extent of human trafficking in
3737 this state, including data described by Subdivisions (4)(A), (B),
3838 (C), (D), and (E);
3939 (3) solicit cooperation and assistance from state and
4040 local governmental agencies, political subdivisions of the state,
4141 nongovernmental organizations, and other persons, as appropriate,
4242 for the purpose of collecting and organizing statistical data under
4343 Subdivision (2);
4444 (4) ensure that each state or local governmental
4545 agency and political subdivision of the state and each state or
4646 local law enforcement agency, district attorney, or county attorney
4747 that assists in the prevention of human trafficking collects
4848 statistical data related to human trafficking, including, as
4949 appropriate:
5050 (A) the number of investigations concerning,
5151 arrests and prosecutions for, and convictions of:
5252 (i) the offense of trafficking of persons;
5353 and
5454 (ii) the offense of forgery or an offense
5555 under Chapter 43, Penal Code, if committed as part of a criminal
5656 episode involving the trafficking of persons;
5757 (B) demographic information on persons who are
5858 convicted of offenses described by Paragraph (A) and persons who
5959 are the victims of those offenses;
6060 (C) geographic routes by which human trafficking
6161 victims are trafficked, including routes by which victims are
6262 trafficked across this state's international border, and
6363 geographic patterns in human trafficking, including the country or
6464 state of origin and the country or state of destination;
6565 (D) means of transportation and methods used by
6666 persons who engage in trafficking to transport their victims; and
6767 (E) social and economic factors that create a
6868 demand for the labor or services that victims of human trafficking
6969 are forced to provide;
7070 (5) work with the Commission on Law Enforcement
7171 Officer Standards and Education to develop and conduct training for
7272 law enforcement personnel, victim service providers, and medical
7373 service providers to identify victims of human trafficking;
7474 (6) on the request of a judge of a county court, county
7575 court at law, or district court or a county attorney, district
7676 attorney, or criminal district attorney, assist and train the judge
7777 or the judge's staff or the attorney or the attorney's staff in the
7878 recognition and prevention of human trafficking;
7979 (7) examine training protocols related to human
8080 trafficking issues, as developed and implemented by federal, state,
8181 and local law enforcement agencies;
8282 (8) collaborate with state and local governmental
8383 agencies, political subdivisions of the state, and nongovernmental
8484 organizations to implement a media awareness campaign in
8585 communities affected by human trafficking;
8686 (9) develop recommendations on how to strengthen state
8787 and local efforts to prevent human trafficking, protect and assist
8888 human trafficking victims, and prosecute human trafficking
8989 offenders; and
9090 (10) examine the extent to which human trafficking is
9191 associated with the operation of sexually oriented businesses, as
9292 defined by Section 243.002, Local Government Code, and the
9393 workplace or public health concerns that are created by the
9494 association of human trafficking and the operation of sexually
9595 oriented businesses.
9696 SECTION 2. This Act takes effect immediately if it receives
9797 a vote of two-thirds of all the members elected to each house, as
9898 provided by Section 39, Article III, Texas Constitution. If this
9999 Act does not receive the vote necessary for immediate effect, this
100100 Act takes effect September 1, 2013.
