7 | 7 | | relating to the collection of information regarding trafficking of |
---|
8 | 8 | | persons. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 402.035, Government Code, is amended by |
---|
11 | 11 | | adding Subsection (b-1) and amending Subsection (d) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (b-1) A state or local law enforcement agency, district |
---|
14 | 14 | | attorney, or county attorney that assists in the prevention of |
---|
15 | 15 | | human trafficking shall, at the request of the task force, |
---|
16 | 16 | | cooperate and assist the task force in collecting any statistical |
---|
17 | 17 | | data on the nature and extent of human trafficking in the possession |
---|
18 | 18 | | of the law enforcement agency or district or county attorney. |
---|
19 | 19 | | (d) The task force shall: |
---|
20 | 20 | | (1) collaborate, as needed to fulfill the duties of |
---|
21 | 21 | | the task force, with: |
---|
22 | 22 | | (A) United States attorneys for the districts of |
---|
23 | 23 | | Texas; and |
---|
24 | 24 | | (B) special agents or customs and border |
---|
25 | 25 | | protection officers and border patrol agents of: |
---|
26 | 26 | | (i) the Federal Bureau of Investigation; |
---|
27 | 27 | | (ii) the United States Drug Enforcement |
---|
28 | 28 | | Administration; |
---|
29 | 29 | | (iii) the Bureau of Alcohol, Tobacco, |
---|
30 | 30 | | Firearms and Explosives; |
---|
31 | 31 | | (iv) [the] United States Immigration and |
---|
32 | 32 | | Customs Enforcement [Agency]; or |
---|
33 | 33 | | (v) the United States Department of |
---|
34 | 34 | | Homeland Security; |
---|
35 | 35 | | (2) collect, organize, and periodically publish |
---|
36 | 36 | | statistical data on the nature and extent of human trafficking in |
---|
37 | 37 | | this state, including data described by Subdivisions (4)(A), (B), |
---|
38 | 38 | | (C), (D), and (E); |
---|
39 | 39 | | (3) solicit cooperation and assistance from state and |
---|
40 | 40 | | local governmental agencies, political subdivisions of the state, |
---|
41 | 41 | | nongovernmental organizations, and other persons, as appropriate, |
---|
42 | 42 | | for the purpose of collecting and organizing statistical data under |
---|
43 | 43 | | Subdivision (2); |
---|
44 | 44 | | (4) ensure that each state or local governmental |
---|
45 | 45 | | agency and political subdivision of the state and each state or |
---|
46 | 46 | | local law enforcement agency, district attorney, or county attorney |
---|
47 | 47 | | that assists in the prevention of human trafficking collects |
---|
48 | 48 | | statistical data related to human trafficking, including, as |
---|
49 | 49 | | appropriate: |
---|
50 | 50 | | (A) the number of investigations concerning, |
---|
51 | 51 | | arrests and prosecutions for, and convictions of: |
---|
52 | 52 | | (i) the offense of trafficking of persons; |
---|
53 | 53 | | and |
---|
54 | 54 | | (ii) the offense of forgery or an offense |
---|
55 | 55 | | under Chapter 43, Penal Code, if committed as part of a criminal |
---|
56 | 56 | | episode involving the trafficking of persons; |
---|
57 | 57 | | (B) demographic information on persons who are |
---|
58 | 58 | | convicted of offenses described by Paragraph (A) and persons who |
---|
59 | 59 | | are the victims of those offenses; |
---|
60 | 60 | | (C) geographic routes by which human trafficking |
---|
61 | 61 | | victims are trafficked, including routes by which victims are |
---|
62 | 62 | | trafficked across this state's international border, and |
---|
63 | 63 | | geographic patterns in human trafficking, including the country or |
---|
64 | 64 | | state of origin and the country or state of destination; |
---|
65 | 65 | | (D) means of transportation and methods used by |
---|
66 | 66 | | persons who engage in trafficking to transport their victims; and |
---|
67 | 67 | | (E) social and economic factors that create a |
---|
68 | 68 | | demand for the labor or services that victims of human trafficking |
---|
69 | 69 | | are forced to provide; |
---|
70 | 70 | | (5) work with the Commission on Law Enforcement |
---|
71 | 71 | | Officer Standards and Education to develop and conduct training for |
---|
72 | 72 | | law enforcement personnel, victim service providers, and medical |
---|
73 | 73 | | service providers to identify victims of human trafficking; |
---|
74 | 74 | | (6) on the request of a judge of a county court, county |
---|
75 | 75 | | court at law, or district court or a county attorney, district |
---|
76 | 76 | | attorney, or criminal district attorney, assist and train the judge |
---|
77 | 77 | | or the judge's staff or the attorney or the attorney's staff in the |
---|
78 | 78 | | recognition and prevention of human trafficking; |
---|
79 | 79 | | (7) examine training protocols related to human |
---|
80 | 80 | | trafficking issues, as developed and implemented by federal, state, |
---|
81 | 81 | | and local law enforcement agencies; |
---|
82 | 82 | | (8) collaborate with state and local governmental |
---|
83 | 83 | | agencies, political subdivisions of the state, and nongovernmental |
---|
84 | 84 | | organizations to implement a media awareness campaign in |
---|
85 | 85 | | communities affected by human trafficking; |
---|
86 | 86 | | (9) develop recommendations on how to strengthen state |
---|
87 | 87 | | and local efforts to prevent human trafficking, protect and assist |
---|
88 | 88 | | human trafficking victims, and prosecute human trafficking |
---|
89 | 89 | | offenders; and |
---|
90 | 90 | | (10) examine the extent to which human trafficking is |
---|
91 | 91 | | associated with the operation of sexually oriented businesses, as |
---|
92 | 92 | | defined by Section 243.002, Local Government Code, and the |
---|
93 | 93 | | workplace or public health concerns that are created by the |
---|
94 | 94 | | association of human trafficking and the operation of sexually |
---|
95 | 95 | | oriented businesses. |
---|
96 | 96 | | SECTION 2. This Act takes effect immediately if it receives |
---|
97 | 97 | | a vote of two-thirds of all the members elected to each house, as |
---|
98 | 98 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
99 | 99 | | Act does not receive the vote necessary for immediate effect, this |
---|
100 | 100 | | Act takes effect September 1, 2013. |
