99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the territory that may be included in a single county
1212 election precinct.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Section 42.005, Election Code, is
1515 amended to read as follows:
1616 Sec. 42.005. RELATIONSHIP TO [WARDS,] DISTRICTS[,] AND
1717 JUSTICE AND COMMISSIONERS PRECINCTS.
1818 SECTION 2. Section 42.005(a), Election Code, is amended to
1919 read as follows:
2020 (a) A county election precinct, including a consolidated
2121 precinct, may not contain territory from more than one of each of
2222 the following types of territorial units:
2323 (1) a commissioners precinct;
2424 (2) a justice precinct;
2525 (3) a congressional district;
2626 (4) a state representative district;
2727 (5) a state senatorial district; or
2828 (6) [a ward in a city with a population of 10,000 or
2929 more; or
3030 [(7)] a State Board of Education district.
3131 SECTION 3. Section 42.010(c), Election Code, is amended to
3232 read as follows:
3333 (c) After each redistricting of a territorial unit
3434 described by Section 42.005(a)(3), (4), (5), or (6) [(7)], the
3535 commissioners court may submit recommendations to the secretary of
3636 state on changes to the territorial units to allow the county to
3737 eliminate county election precincts with no population or a
3838 substantially small population.
3939 SECTION 4. Sections 42.005(c) and (d) and 42.010(a),
4040 Election Code, are repealed.
4141 SECTION 5. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2013.
