| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. The heading to Section 42.005, Election Code, is |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | Sec. 42.005. RELATIONSHIP TO [WARDS,] DISTRICTS[,] AND |
|---|
| 17 | 17 | | JUSTICE AND COMMISSIONERS PRECINCTS. |
|---|
| 18 | 18 | | SECTION 2. Section 42.005(a), Election Code, is amended to |
|---|
| 19 | 19 | | read as follows: |
|---|
| 20 | 20 | | (a) A county election precinct, including a consolidated |
|---|
| 21 | 21 | | precinct, may not contain territory from more than one of each of |
|---|
| 22 | 22 | | the following types of territorial units: |
|---|
| 23 | 23 | | (1) a commissioners precinct; |
|---|
| 24 | 24 | | (2) a justice precinct; |
|---|
| 25 | 25 | | (3) a congressional district; |
|---|
| 26 | 26 | | (4) a state representative district; |
|---|
| 27 | 27 | | (5) a state senatorial district; or |
|---|
| 28 | 28 | | (6) [a ward in a city with a population of 10,000 or |
|---|
| 29 | 29 | | more; or |
|---|
| 30 | 30 | | [(7)] a State Board of Education district. |

| 31 | 31 | | SECTION 3. Section 42.010(c), Election Code, is amended to |
|---|
| 32 | 32 | | read as follows: |
|---|
| 33 | 33 | | (c) After each redistricting of a territorial unit |
|---|
| 34 | 34 | | described by Section 42.005(a)(3), (4), (5), or (6) [(7)], the |
|---|
| 35 | 35 | | commissioners court may submit recommendations to the secretary of |
|---|
| 36 | 36 | | state on changes to the territorial units to allow the county to |
|---|
| 37 | 37 | | eliminate county election precincts with no population or a |
|---|
| 38 | 38 | | substantially small population. |
|---|
| 39 | 39 | | SECTION 4. Sections 42.005(c) and (d) and 42.010(a), |
|---|
| 40 | 40 | | Election Code, are repealed. |
|---|
| 41 | 41 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2013. |
