| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 711.035(e), Health and Safety Code, is | |
| 13 | 13 | amended to read as follows: | |
| 14 | 14 | (e) All property of a dedicated cemetery, including a road, | |
| 15 | 15 | alley, or walk in the cemetery: | |
| 16 | 16 | (1) is exempt from public improvements assessments, | |
| 17 | 17 | fees, including drainage fees or charges, and public taxation; and | |
| 18 | 18 | (2) may not be sold on execution or applied in payment | |
| 19 | 19 | of debts due from individual owners and plots. | |
| 20 | 20 | SECTION 2. The amendment to Section 711.035(e), Health and | |
| 21 | 21 | Safety Code, by this Act is intended to clarify rather than change | |
| 22 | 22 | existing law. | |
| 23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2013. |
