99 relating to all-terrain vehicles and recreational off-highway
1010 vehicles.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 502.001(1) and (37), Transportation
1313 Code, are amended to read as follows:
1414 (1) "All-terrain vehicle" means a motor vehicle that
1515 is:
1616 (A) equipped with a seat or seats [saddle] for
1717 the use of:
1818 (i) the rider; and
1919 (ii) a passenger, if the motor vehicle is
2020 designed by the manufacturer to transport a passenger;
2121 (B) designed to propel itself with three or more
2222 tires in contact with the ground;
2323 (C) designed by the manufacturer for off-highway
2424 use; [and]
2525 (D) not designed by the manufacturer primarily
2626 for farming or lawn care; and
2727 (E) not more than 50 inches wide.
2828 (37) "Recreational off-highway vehicle" means a motor
2929 vehicle that is:
3030 (A) equipped with a [non-straddle] seat or seats
3131 for the use of:
3232 (i) the rider; and
3333 (ii) a passenger or passengers, if the
3434 vehicle is designed by the manufacturer to transport a passenger or
3535 passengers;
3636 (B) designed to propel itself with four or more
3737 tires in contact with the ground;
3838 (C) designed by the manufacturer for off-highway
3939 use by the operator only; [and]
4040 (D) not designed by the manufacturer primarily
4141 for farming or lawn care; and
4242 (E) not more than 65 inches wide.
4343 SECTION 2. Section 663.001(1), Transportation Code, is
4444 amended to read as follows:
4545 (1) "All-terrain vehicle" means a motor vehicle that
4646 is:
4747 (A) equipped with a seat or seats [saddle] for
4848 the use of:
4949 (i) the rider; and
5050 (ii) a passenger, if the motor vehicle is
5151 designed by the manufacturer to transport a passenger;
5252 (B) designed to propel itself with three or four
5353 tires in contact with the ground;
5454 (C) designed by the manufacturer for off-highway
5555 use by the operator only; [and]
5656 (D) not designed by the manufacturer for farming
5757 or lawn care; and
5858 (E) not more than 50 inches wide.
5959 SECTION 3. This Act takes effect September 1, 2013.
