| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 545.066(c), Transportation Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (c) An offense under this section is a misdemeanor |
|---|
| 16 | 16 | | punishable by a fine of not less than $500 [$200] or more than |
|---|
| 17 | 17 | | $1,250 [$1,000], except that the offense is: |
|---|
| 18 | 18 | | (1) a misdemeanor punishable by a fine of not less than |
|---|
| 19 | 19 | | $1,000 or more than $2,000 if the person is convicted of a second or |
|---|
| 20 | 20 | | subsequent offense under this section committed within five years |
|---|
| 21 | 21 | | of the date on which the most recent preceding offense was |
|---|
| 22 | 22 | | committed; |
|---|
| 23 | 23 | | (2) a Class A misdemeanor if the person causes serious |
|---|
| 24 | 24 | | bodily injury to another; or |
|---|
| 25 | 25 | | (3) [(2)] a state jail felony if the person has been |
|---|
| 26 | 26 | | previously convicted under Subdivision (2) [(1)]. |
|---|
| 27 | 27 | | SECTION 2. (a) The change in law made by this Act applies |
|---|
| 28 | 28 | | only to an offense committed on or after September 1, 2013. |
|---|
| 29 | 29 | | (b) An offense committed before September 1, 2013, is |
|---|
| 30 | 30 | | covered by the law in effect when the offense was committed, and the |
|---|
| 31 | 31 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 32 | 32 | | this subsection, an offense was committed before September 1, 2013, |
|---|
| 33 | 33 | | if any element of the offense was committed before that date. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect September 1, 2013. |
