99 AN ACT
1010 relating to the penalties for illegally passing a stopped school
1111 bus.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 545.066(c), Transportation Code, is
1414 amended to read as follows:
1515 (c) An offense under this section is a misdemeanor
1616 punishable by a fine of not less than $500 [$200] or more than
1717 $1,250 [$1,000], except that the offense is:
1818 (1) a misdemeanor punishable by a fine of not less than
1919 $1,000 or more than $2,000 if the person is convicted of a second or
2020 subsequent offense under this section committed within five years
2121 of the date on which the most recent preceding offense was
2222 committed;
2323 (2) a Class A misdemeanor if the person causes serious
2424 bodily injury to another; or
2525 (3) [(2)] a state jail felony if the person has been
2626 previously convicted under Subdivision (2) [(1)].
2727 SECTION 2. (a) The change in law made by this Act applies
2828 only to an offense committed on or after September 1, 2013.
2929 (b) An offense committed before September 1, 2013, is
3030 covered by the law in effect when the offense was committed, and the
3131 former law is continued in effect for that purpose. For purposes of
3232 this subsection, an offense was committed before September 1, 2013,
3333 if any element of the offense was committed before that date.
3434 SECTION 3. This Act takes effect September 1, 2013.
